In March, the San Antonio City Council voted to remove a proposed Chick-fil-A location from its airport concession agreement, citing the fast food chain’s record of donating to organizations that discriminated against LGBTQ people. Now, conservatives in the Texas state legislature are trying to pass a law that would ensure something like that never happens again.

On Wednesday night, the state Senate passed a bill that would forbid the government from penalizing businesses (and individuals) on the basis of their charitable giving or religious affiliation, the Dallas Morning News reports. The bill, which supporters call the “Save Chick-fil-A bill,” now has to pass in the state Senate once more before moving to the House.

If it passes, the bill would prohibit any government entity from taking “adverse actions” against an individual or business for their “membership in, affiliation with, or contribution, donation, or other support to a religious organization.” It’s impossible to not see this bill as an explicit defense of Chick-fil-A, which continues to make headlines for its charitable donations to organizations that discriminate against LGBTQ people, including the Fellowship of Christian Athletes, a religious organization that requires its employees to refrain from “homosexual acts.

Republican lawmakers in Texas are pushing legislation — dubbed the “Save Chick-fil-A” bill — that they say is about protecting the religious beliefs and moral convictions of individuals and businesses. Critics, however, allege the measure is part of a nationwide effort to use religion as a weapon to discriminate against LGBTQ people.

Samantha Smoot, interim executive director of Equality Texas, a statewide LGBTQ advocacy group, told NBC News. “This is a part of a national initiative to pass legislation that is going to hurt the LGBTQ community.”

To suggest our giving was done to support a political or non-inclusive agenda is inaccurate and misleading.”

Sen. Donna Campbell, R-New Braunfels, said failing to protect Christian beliefs put all faiths at risk: “The headlines are about Chick-fil-A. Who’s next? Who’s beliefs are on the line next?”

Democrats repeatedly attempted to delay, derail or amend what they said was a bill that would tie the hands of local governments and allow Texans to cite their faith in order to discriminate against people based on their gender identity or sexual orientation.

“The bill does nothing but target the GLBT community,” Sen. Borris Miles, D-Houston, said. “It sends the wrong message that Texas discriminates, plain and simple.”

Sen. John Whitmire, another Houston Democrat who is the chamber’s longest serving member, said he was speaking against the bill on behalf of his lesbian, gay, bisexual and transgender friends and constituents.

“I know they’re watching this discussion,” Whitmire said, nodding to past debates over legislation like the bathroom bill, which would have restricted restroom access for transgender people. “I can speak for them on the Senate floor. All they want to do is be left alone to raise their families, work, pay taxes and not be the subject of a divisive debate again.”

Last week, the newly formed Texas House LGBTQ Caucus killed a bill similar to this one before there was any debate, a huge victory for Democrats in that chamber. But Hughes soon revived the effort in the Senate, and his bill was fast-tracked through committee and to the floor in a matter of days. 

Lt. Gov. Dan Patrick has prioritized legislation like Hughes’ this year and Speaker Dennis Bonnen, speaking on the issue with Spectrum News on Wednesday, said he too supports the legislation and believes it would pass in the House if it comes up for a vote.
