The Biden administration’s rule requiring states to measure and report greenhouse gas emissions from vehicles on the national highway system was struck down by a judge in Texas on March 28. The rule, issued by the U.S. Department of Transportation’s Federal Highway Administration in 2023, aimed to reduce carbon emissions by half by 2030. State transportation departments and metropolitan planning organizations were mandated to measure emissions and set reduction targets, with progress reports due biennially. Texas sued the DOT, claiming lack of legal authority and violation of the Administrative Procedure Act.
