The U.S. Supreme Court declined to block a vaccine mandate for health workers in the state of Maine on Tuesday, sending a potential green light to state mandates across the country.
It was the first time the Supreme Court weighed in on a statewide vaccine mandate. It previously rejected challenges of vaccine requirements for New York City teachers and Indiana University staff and students.
Justice Stephen Breyer rejected the emergency appeal but left the door open to try again as the clock ticks on Maine’s mandate. The state will begin enforcing it Oct. 29.
The Maine vaccine requirement that was put in place by Democratic Gov. Janet Mills requires hospital and nursing home workers to get vaccinated or risk losing their jobs.
Opponents tried to block the mandate, but a federal judge rejected the request Oct. 13. The judge said the record indicated regular testing alone wasn’t sufficient to stop the spread of the delta variant.
That decision set off a flurry of emergency appeals to the 1st U.S. Circuit Court of Appeals and then the U.S. Supreme Court.
A three-judge panel of the appeals court in Boston quickly dismissed the emergency appeal but fast-tracked additional arguments. That timetable provides enough time for another ruling before enforcement of the vaccine mandate begins at the end of next week.
Mat Staver, founder and chair of the Liberty Counsel, which challenged the vaccine mandate, said the Supreme Court is ready to consider the case “if we do not get relief” from the appeals court in the coming days.
The Maine attorney general’s office declined to comment.
The Liberty Counsel, which filed the lawsuit in federal court in Maine in August, claimed to be representing more than 2,000 health care workers who don’t want to be forced to be vaccinated. Read More
The "Watchman Says" ruling by the Supreme Court is another ludicrous one. Allow us to attend to our own business. They pose a threat to even the liberties of ordinary Americans.
We now know that the government's mandates and the resulting concern over a "COVID pandemic" were futile attempts to contain the virus.
Some Republicans in the House lost pay in 2021 and 2022 for refusing to wear masks required by the COVID-19 pandemic. Now the Supreme Court won't hear their appeal.
The complaint that the lawmakers initiated. The Republicans from South Carolina, Georgia, and Kentucky, Ralph Norman, Marjorie Taylor Greene, and Thomas Massie, were all denied by the lower courts.
According to reports, Ms. Greene was fined over $100,000 for disobeying the COVID pandemic rule that mandated the wearing of masks on the house floor. From her $174,000 pay, that sum was subtracted.
They had $500 withheld from their congressional salary for every infraction. Legislators are claiming that the deductions are unconstitutional because they run counter to the 27th Amendment, which states that pay raises for senators and state representatives cannot take effect until "an intervening election."
Mr. Massie told The Epoch Times that there is more to the matter than only the mask mandate in response to the Supreme Court's move.
"The courts have rendered the 27th Amendment unenforceable," he argued, adding that Congress might be insulated by the speech or debate clause even for conduct clearly prohibited by the Constitution.
The Supreme Court's departure from constitutional principles is plainly demonstrated by this ruling. The Supreme Court has devolved into an exclusive club of clowns dressed in black who represent different powerful interests—certainly not the American people or our traditions. They, along with the remainder of our government, are cogs in the wheel of despotism and tyranny.
