Under the Alien Enemies Act (AEA) of 1978, a federal judge who has been a critical friend to the deep state has preemptively stopped the Trump government from deporting five Venezuelan nationals.

Few hours after the American Civil Liberties Union (ACLU) submitted a motion on the behalf of the Venezuelan people against Trump’s claimed intention to use the AEA to hasten the expulsion of illegals from the US, US District Judge James Boasberg (more on that below) announced his preemptive ruling.

Though Trump hasn’t yet used the statute, the ACLU requested Boasberg to forbid its application. Of course, Boasberg complied, giving a restraining order Saturday morning that stops the government from removing the five Venezuelan nationals for two weeks so the court may hear their argument.

Along with Democracy Forward and the ACLU of the District of Columbia, the ACLU claimed in their lawsuit that the government relocated alleged Tren De Aragua members to a Texas facility allegedly used as staging grounds to remove Venezuelan men under the AEA.

Notably last month, the Trump government formally classified Tren de Aragua as a terrorist group.
