Over 140 Democrats in the House want to bring back the part of the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act that lets veterans be limited in certain situations in their ability to buy or own guns.

The VA has been telling the National Instant Criminal Background Check System (NICS) for a long time about soldiers who are having mental health issues. These worries cover cases in which veterans use a fiduciary to manage their VA benefits. But this year, the Senate got rid of the gun ban in the Clinton area thanks to an amendment put forward by Sen. John Kennedy (R-LA).

Kennedy said, “Unelected bureaucrats shouldn’t be able to take away veterans’ rights to the Second Amendment without a vote.” By passing my amendment today, the Senate did the right thing for soldiers and all Americans who love freedom.

There is anger among the Democrats in the House, and they want the gun ban to be reinstated in the spending bill.

It is against common sense to follow the Kennedy Amendment, which makes sure that soldiers who are found to be “mentally incompetent” are added to the National Instant Criminal Background Check System (NICS). As required by law, the Department of Veterans Affairs (VA) makes a competency determination. The current process allows for appeals and helps make sure that veterans who are a danger to themselves or others are flagged in the background check system if they try to buy a gun.
