Watchman The End of Free Speech and Expression: The EU Signs a Law to ‘Police’ the Entire Internet and Take Down Websites With Unapproved Speech

HNewsWire: Special Counsel John Durham released his final report on Monday following over three years of investigation into the FBI’s handling of the Trump-Russia probe. According to Just the News, the report concludes that the FBI had no verified intelligence or evidence when it opened up an investigation into Donald Trump and his campaign in the summer of 2016. The measure was passed in October 2022 and went into force the following November. The next section of the measure went into force this month, allowing some of the bill's fangs to be sunken in.

According to the bill's dedicated website, "17 very large online platforms (VLOPs) and 2 very large online search engines (VLOSEs) that reach at least 45 million monthly active users" will be the first to be legally required to comply. They are as follows:

Since their implementation, a slew of specified conditions have been enforced and placed on "offer" for users of these sites, some of which include:

Users will be given explicit explanations as to why they are being recommended specific material and will have the option to opt out of recommendation systems based on profiling.
Platforms and search engines must take steps to address the hazards associated with the online distribution of unlawful content, as well as the detrimental repercussions on freedom of expression and information; platforms must have clear terms and conditions and enforce them diligently and arbitrarily.
Platforms must have a way for users to flag illegal content and respond to notifications quickly.
Platforms must assess their specific risks and implement mitigation measures, such as addressing the spread of misinformation and inauthentic use of their service.

The EU defines "disinformation" as "false or misleading content that is spread with the intent to deceive or secure economic or political gain and which may cause public harm," and such a code has proven effective "during electoral periods and in rapidly responding to crises, such as the coronavirus pandemic and the war in Ukraine."

To establish whether anything is disinformation, "trusted flaggers" will be hired to help with fact-checking and censorship. According to the EU, these flaggers are "entities that have demonstrated particular expertise and competence in reporting illegal content to which platforms must respond with priority."

Euractiv goes on to say who these flaggers will be: 'Yet, these entities, many of which are likely to be NGOs, will have to acquire digital skills on top of their fundamental rights expertise in order to effectively flag illicit content to platforms, and will need financial backing to deliver their services.'

However, beginning February 24th, 2024, this bill will span the entire internet by targeting outlets with 45 million monthly views or less.

By February 17, 2024, EU Member States will be required to designate Digital Services Coordinators, and platforms with fewer than 45 million active users will be required to comply with all DSA standards.

The EU Commission further stated

Furthermore, the new rule imposes severe penalties and fines for noncompliance, with a possible suspension of "fines of up to 6 percent of their global turnover."

The new enforcement mechanism will monitor how online intermediaries adjust their systems to the new criteria through national and EU-level collaboration. Each Member State must nominate a Digital Services Coordinator, an independent entity in charge of supervising the intermediate services established in their country and/or working with specialised sectoral authorities. It will enforce penalties, including financial fines, to accomplish this. Each Member State will explicitly establish the penalties in their national laws in accordance with the Regulation, ensuring that they are commensurate to the nature and seriousness of the infringement while also being dissuasive to guarantee compliance.

In the event of extremely big online platforms and very large online search engines, the Commission will have direct supervisory and enforcement powers and can impose fines of up to 6% of a service provider's global sales in the most serious situations.

The enforcement mechanism will not be restricted to fines; the Digital Services Coordinator and the Commission will have the authority to mandate prompt action to address extremely substantial harms, and platforms may give pledges on how they will fix them.

Rogue platforms that refuse to comply with important requirements, risking people's lives and safety, will be able to approach a court for a temporary suspension of their service after involving all necessary parties as a last resort.

The EU is threatening

But, lest anyone imagine that this rule exclusively applies to the EU, the US government has discreetly approved its enforcement in the states.

According to a letter from the United States Senate Committee on Commerce, Science, and Transportation, which confirms these impacts on American land,

Senator Ted Cruz (R-Texas) of the United States Senate Commerce Committee today sent letters to FTC Chairwoman Lina Khan and the head of the European Union's San Francisco office, demanding answers about the degree of coordination between the FTC and the EU to enforce the EU's Digital Services Act ("DSA") and Digital Markets Act ("DMA") on U.S. soil. Both foreign regulations were drafted in order to damage American technology firms, notably in Europe. Because the DSA and DMA have no equivalent federal regulations, the FTC's efforts to collude with foreign regulators against US corporations are unique.

In March, the FTC stated that it will deploy agency staff to Brussels to assist the EU in enforcing these laws, while the EU built a San Francisco office to encourage U.S. internet companies to comply.
