Attorney General Ken Paxton Secures Emergency Relief In Favor of Texas Border Security Law

AUSTIN – Texas Attorney General Ken Paxton successfully secured an emergency stay of a district court ruling that would have blocked Texas’s new border security law known as SB 4 from taking effect.

The emergency stay granted by the Fifth Circuit has itself been stayed for seven days to allow the federal government to seek review by the Supreme Court of the United States. Further, the Fifth Circuit ordered that this appeal be expedited and argued immediately.

SB 4 was adopted to address the ongoing crisis at the southern border, which hurts Texans more than anyone else. SB 4 mirrors federal law making it a crime to illegally enter or reenter the country. It also enables Texas law enforcement to assist federal efforts by detaining and ordering aliens to return to the country from which they illegally entered.

A court of federal appeals has given permission for the Texas Immigration law Senate Bill 4 to go into effect on Monday. This law gives law enforcement in the state the authority to arrest persons who have illegally entered the United States of America, provided that the Supreme Court does not decide to exercise its authority to interfere.

Following the judgment of a lower court to stop the law, which allows law enforcement the right to arrest migrants suspected of unlawfully entering the country, the 5th United States Circuit Court of Appeals issued a temporary stay of the ruling. This comes after the bill was first blocked.

BREAKING NEWS OF IMPORTANCE With the approval of the federal appeals court, the immigration statute of Texas is now lawful. Since recently, law enforcement personnel in the state of Texas have been given the authority to detain and arrest any illegal immigrants who cross the border. The Republican governor of Texas, Greg Abbott, made a post on X, which was formerly known as Twitter.

The Fifth Circuit Court of Appeals said that it will postpone its ruling for a period of seven days in order to provide the federal government with the opportunity to appeal the decision to the Supreme Court of the United States.

According to statements made by Republican Governor Gregg Abbott of Texas this week, "Texas has the constitutional right to defend itself because of President Biden's ongoing failure to fulfill his duty." "In our fight to protect Texas, we will not give up," the statement read. The Supreme Court of the United States will finally make a decision about this issue.

On Thursday, United States District Judge David Ezra stopped the bill, rebuking assertions made by Republicans over the fact that the Southern border was being hit with an invasion following record-high illegal crossings.

As an additional provision, the Texas law would make it possible for state judges to issue orders compelling persons who have broken the law to leave the nation immediately. Those who fail to comply with these orders may face jail sentences of up to twenty years.

On the other hand, those who are opposed to the law assert that it is the most significant action that has been taken since the United States Supreme Court struck down a bill from Arizona that was referred to as the "Show Me Your Papers" bill in 2010.

War? 25 Red States Rally 'Round Texas As Battle Brews With Biden Over Border

A coalition of red states has rallied around Texas, after Governor Greg Abbott invoked the state's constitutional right to self-defense due to the migrant crisis, which he deemed an 'invasion.'

As End Wokeness notes, a coalition of 25 Republican governors have signed a joint letter in support of the Texas resistance.

The support began on Wednesday, with Governor Kevin Stitt tweeting: "Oklahoma stands with Texas."

"TX is upholding the law while Biden is flouting it," said Florida Gov. Ron DeSantis.

And of course, the optics couldn't be worse for the Biden administration - which is now faced with the prospect of going to war with Texas, during an election year, to keep the border open.

And Wall Street Silver pointed out on X, Texas is authorized to engage in war if being invaded according to Article 1, Section 10, Clause 3 of the Constitution.

Though as X user blueapples points out, Abbott cited the dissenting (losing) position in Arizona v. United States which determined that federal law overrides state laws when it comes to regulating those who are unlawfully present in the US, except when it comes to a state's right to require officers to verify the citizenship or alien status of detained migrants.

Regardless, Abbott has drawn a line in the sand - and whatever litigation may play out in the courts is secondary to the fact that this is happening now.

As journalist Matt Walsh notes, "Abbott has Biden over a barrel here."

"What is Biden going to do? Send the military in to forcibly open the border? In an election year?"

Meanwhile in Washington, Senate Minority Leader Mitch McConnell (R-KY) told fellow Republicans in a private meeting on Ukraine that time and the political will to pass a bipartisan immigration and border security compromise is running out, Punchbowl News reports.

According to the outlet:

McConnell told GOP senators that before border security talks began, immigration policy united Republicans and Ukraine aid divided them. “Politics on this have changed,” McConnell said of solving the crisis at the U.S.-Mexico border. That’s because former President Donald Trump wants to run his 2024 campaign focusing on immigration.

"We don’t want to do anything to undermine him," McConnell said of Trump - effectively backing away from the 'border-security-for-Ukraine' construct that Republicans have been clinging to the last few months.

SRH: The states need to take action and reclaim their authority over the federal government, and this is an excellent illustration of why they need to do so. Every single person must keep in mind… The federal government was established by the states in order to carry out a limited number of significant functions. We need to remind the bureaucrats in Washington, DC of this. HNewsWire: By SRH, The Texas National Guard has taken control of a park at the U.S. southern border and is preventing federal agents from accessing the area. This action is viewed as a notable increase in tensions between the state and the Biden administration. According to two government officials, there seems to be some confusion regarding the authority of Texas officials over the federal government. They have reportedly been contesting entry to Border Patrol agents,…

Watchman: Democrats Want Biden to Take Control of the National Guard in Texas, Memo Not gonna Happen! Texans Will Defend Our Republic,Our Families and The Country

By StevieRay Hansen | January 25, 2024 |

By SRH: Democrats Want Biden to Take Command of the National Guard in Texas Democrats are pressuring Joe Biden to assume control of the Texas National Guard, as Governor Greg Abbott (R-Texas) continues to oppose the Biden administration’s open-border policy. Democrat Texas Reps. Joaquin Castro and Greg Casar made remarks on Tuesday and Wednesday requesting Biden to “establish sole federal control of the Texas National Guard” after Abbott said that “the Texas National Guard continues to hold the line in Eagle Pass.” Texas would not abandon its attempts to safeguard the border in Biden’s absence.” The Texas governor’s statement came after the Supreme Court ruled 5-4 on Monday, allowing the Biden administration to demolish the razor-wire fencing Texas has built to safeguard its southern border. Abbott also stated on social media that the state would continue to safeguard the border…
