Special Counsel Jack Smith's team revealed a surprising admission in its case against former President Donald Trump in a recent court filing: it falsely stated that it had handed all material to Mr. Trump's legal team, while failing to do so.
Mr. Smith's team admitted in a court filing on July 31 (pdf) in its classified documents case against the former president that it falsely claimed during a court hearing on July 18 that it had given Mr. Trump's defense attorneys access to all Mar-a-Lago surveillance footage in accordance with the law.
"On July 27, as part of the preparation for the superseding indictment coming later that day and the discovery production for Defendant De Oliveira, the Government learned that this footage had not been processed and uploaded to the platform established for the defense to view the subpoenaed footage," Mr. Smith's team wrote in the most recent filing.
"As a result, the Government's representation at the July 18 hearing that all surveillance footage obtained prior to the indictment had been produced was incorrect," it added.
Prosecutors in a criminal prosecution have a constitutional duty to reveal all evidence to a defendant's legal team, including material that is favorable to the accused and could decrease a potential sentence, according to the so-called Brady rule.
Mr. Smith's team's admission is ironic, because it accused Mr. Trump in a new "superseding indictment" (pdf) filed on July 27 of conspiring with his aides to remove some surveillance footage so that the grand jury in the case would not see all of the evidence.

Trump denies erasing the tapes.
The special counsel accused Mr. Trump with deliberate retention of national defense material, as well as two charges related to assertions that he instructed a Mar-a-Lago employee to erase security footage in order to prevent a grand jury from viewing them.
Carlos De Oliveira, a Mar-a-Lago staffer, has been listed as a third defendant in the superseding indictment, alongside Trump adviser Walt Nauta and the former commander-in-chief himself.
Mr. Trump moved to Twitter to refute the fresh allegations, stating that Mr. Smith's assertion of security footage being erased was incorrect and amounted to election interference ahead of the 2024 election.
"THE DELETION OF THE SECURITY TAPES WAS A MADE-UP LIE BY DERANGED JACK SMITH!" "ELECTION INTERFERENCE," Mr. Trump wrote in all caps in an Aug. 1 post on Truth Social.
Prosecutors contend in the superseding indictment that Mr. De Oliveira told another Mar-a-Lago employee that "the boss" wanted a server "deleted" on June 27, 2022. This happened around two months before FBI agents raided the former president's Palm Beach resort and allegedly discovered sensitive materials in a storage facility.
Mr. Trump has stated that he utilized presidential authority to declassify all pertinent documents in the case against him and has denied any collusion with the government.
Mr. Trump's campaign said in a statement following the July 27 revelation of a superseding indictment and new charges that it was a "continued desperate and flailing attempt" to harass the former president.
"Deranged Jack Smith realizes they have no case and is looking for any way to salvage their illegal witch hunt and get someone other than Donald Trump to run against Crooked Joe Biden," the campaign team stated.
An average of polling data provided by RealClear Politics shows President Joe Biden and Mr. Trump in a very close matchup, with the former holding a 0.9 percentage point edge.
The superseding indictment against Mr. Smith brings the total number of charges in the classified documents case to 40.

Other Trump Matters
The former president, who is the Republican presidential nominee for 2024, is embroiled in a number of court battles.
Mr. Trump's role in the acts surrounding his challenges to the 2020 presidential election, which ended in a breach of the United States Capitol on Jan. 6, 2021, is being investigated by U.S. Attorney General Merrick Garland. Mr. Trump stated that his attorneys spoke with Justice Department officials on July 27, indicating that charges could be filed soon.
Mr. Trump has been charged by Special Counsel Jack Smith of illegally keeping sensitive national security materials after he left office in 2021 and of lying to those who attempted to recover them.
Mr. Trump pleaded not guilty on June 13 to the accusations, which included alleged violations of the Espionage Act, which makes unauthorized possession of defense material a crime.
Mr. Trump has been accused by a grand jury in New York for allegedly falsifying business documents in connection with a payment to adult film actress Stormy Daniels prior to the 2016 presidential election.
The New York Attorney General, Letitia James, has also launched a civil complaint against Mr. Trump in New York, alleging fraud.
