Texas’ case against Pfizer was dismissed by a federal judge because the COVID-19 pandemic emergency shields Pfizer. In his Dec. 30 order, U.S. District Judge Sam R. Cummings stated several laws protect Pfizer from vaccine efficacy misrepresentations.
“The Court finds that as a matter of law under the circumstances of this case, the Defendant is entitled to immunity under the PREP Act,” Cummings wrote.

The PREP Act and Food, Drug, and Cosmetic Act supersede Texas’ charges, he added. In 2023, Texas Attorney General Ken Paxton sued Pfizer in county court for misrepresenting its COVID-19 vaccine clinical trial results.
Pfizer and its partner claimed the vaccination was 95% effective against COVID-19, although they used only two months of study data.
