Hillary Clinton has opted to disregard the First Amendment and has argued for punitive measures against Americans who contribute to the spread of what she labels “propaganda.” Speaking to MSNBC on Tuesday, Clinton indicated that holding American citizens accountable through civil or criminal charges could act as a deterrent to the spread of “disinformation.”

Clinton claimed that Americans who spread “disinformation” should face consequences, even if she understood the importance of indicting foreign actors, notably Russians, who are directly responsible for interference in US elections.

Her words were: “I believe it’s crucial to indict the Russians for their direct election interference and support of [former US President Donald] Trump in 2016.” “But I also believe that there are Americans involved in this type of propaganda, and it would be more effective to charge them civilly or, in certain cases, criminally.”

Clinton, who ran against Trump in the 2016 presidential election, supported the State and Justice Departments’ continued efforts to uncover the scope of Russian interference in US elections. Clinton has long claimed that her loss in 2016 was due to Russian influence. She regarded these initiatives as only scraping the surface of a much broader issue, saying, “There is a long way to go.”

Her remarks also addressed the larger issue of foreign influence in American politics, with Clinton warning that adversaries like as Russia, China, and Iran are attempting to manipulate the US electorate.

She emphasized the need for more vigilance in defending the democratic process, saying, “We are not going to let adversaries, whether it’s Russia, China, Iran, or anybody else, basically try to influence Americans as to how we should vote in picking our leaders.”

Clinton’s proposal for potential criminal sanctions against US residents who distribute “disinformation” is a contentious step toward limiting free speech. The idea of punishing individuals for disseminating information, regardless of its source, raises questions about the limits of government power and the possibility of such laws being abused to stifle dissent.

The First Amendment to the United States Constitution bans Congress from passing laws that restrict free expression. Under this protection, prosecuting anyone for simply sharing information—regardless of its veracity—poses a potential contradiction with these fundamental rights.
