Parents Of Disabled Child Claim Repeal Of School Mask Mandate Is Discriminatory; Litigation Follows.

The parents of a medically vulnerable 6-year-old kid have filed a lawsuit in Pennsylvania, requesting that the Cumberland Valley School District change its masking policy from optional to mandatory for all students.

According to the lawsuit, which was filed in the United States District Court for the Middle District of Pennsylvania, the school board forces parents of medically fragile children with disabilities to make an unfair choice between keeping their children at home and safe or sending them to school and risking exposure to COVID-19.

The state health agency implemented universal masking in Pennsylvania schools in 2020 to prevent the spread of COVID-19, but a judge ruled in December 2021 that the health department lacked the right to continue imposing masked without a continuing state emergency order. School boards were now in charge of making choices.

The Cumberland Valley School Board made masking optional on January 3rd.

However, the parents who filed the complaint claim that this makes it hazardous, and that by enforcing the mask requirement, the school is denying a protected class of disabled people access to a public place. They compared it to removing all wheelchair ramps from school buildings, which would be an obvious violation of the ADA.

In this situation, the parents’ names are unknown. Jane Doe 1 and John Doe 1, who is likewise medically vulnerable, have filed it. They are the parents of Child Doe 1 as well as other youngsters who may have brought the virus home from school.

This is a class action lawsuit, which means it could affect any students in the district who have ADA-protected medical conditions and require a disguised environment. Students with asthma, COPD, chorionic liver or kidney disease, diabetes, high blood pressure, blood diseases, impaired immune systems, cancer, or spinal cord injury may fall into this category. According to court documents, the school district has about 1,600 pupils in this protected impaired class, and permitting optional masking is discriminatory.

The parents requested an emergency injunction granting a temporary restraining order, requiring the school to reinstate masking until the court action is being resolved. After hearing from the school, District Judge Christopher C. Conner stated he would make a decision. On March 5, a hearing will be held.

Michael Cassidy, the attorney for the Cumberland Valley School District, told The Epoch Times that he couldn’t comment on pending litigation.

Alexander Saksen, the attorney for the Doe Parents, did not reply to requests for comment.

Thomas Quinn Jr. has four students in the district, one of whom had to stop going because the masks were affecting his health. Quinn advises that the masks be decided by a vote among the pupils.

“The children are the ones who are most harmed,” Quinn said. “We tell kids their opinion is important, but when it comes down to it, we tell them to shut up.” So, instead of pushing our messages into their heads, it’s time to listen to what they have to say.

“I’m sick of folks stamping their feet like a kid whenever steps are taken to restore normalcy,” Quinn added. “The needs of the many should take precedence over those of the few.” This parent doesn’t like the fact that the masks are optional? Fine. Go virtual. That is your choice.”

The data has never indicated that children are at risk of infection or severe illness from COVID-19 throughout this entire plandemic. What we’re witnessing is the brainwashed left putting their loyalty to a tyrannical globalist agenda on display despite their lack of understanding of the implications. The data has shown however, that masking these children is extremely harmful psychologically. It’s very hard to watch these parents believe that they’re doing the right thing by sending their kids to school masked and incapable of learning social cues. To vaccinate these children is a whole other level of deranged, as the data has never suggested that these children require such inoculations. Yet as we already know, these parent are paying their dues to the tyrants in hope for protection and dependence. Stay inquisitive in the word of God, and the world around you.
