HNewsWire: On Tuesday, the Biden administration sued Arizona to stop a new law demanding proof of citizenship in order to vote in federal elections.

Assistant Attorney General Kristen Clarke of the Justice Department's Civil Rights Division called it a "textbook violation of the National Voter Registration Act," and said the law's requirement was "onerous," particularly provisions such as "requiring election officials to reject voter registration forms based on errors or omissions that are not material to establishing a voter's eligibility to cast a ballot."

The proposed rule will compel voters to provide proof of citizenship in the form of a driver's license, passport, birth certificate, or naturalization paperwork.

Clarke said that the new legislation, which will go into effect in January after being signed into law by Republican Gov. Doug Ducey, is comparable to an Arizona statute that was overturned by the US Supreme Court in 2013.

According to the lawsuit, the counsel representing Arizona lawmakers advised them that the bill would violate federal law and contradict a previous Supreme Court decision. According to the court filing, House Speaker Pro Tempore Travis Grantham said that attempting again "is a battle worth having."

By initiating the case, state Attorney General Mark Brnovich implied that the Justice Department was encouraging unauthorized immigrants to vote. "I will be in court once again protecting Arizona against the Biden administration's lawlessness," Brnovich stated Tuesday. -From NBC News

Biden as his DOJ continues its attempts to undermine our election integrity laws."

In a letter to Clarke, Arizona Attorney General Mark Brnovich said that he intends to defend Arizona's H.B. 2492 all the way to the United States Supreme Court if necessary. He cited his win in a related election integrity litigation last year, in which he successfully argued before the Supreme Court that Arizona's election integrity rules and regulations did not violate the Voting Rights Act or the Constitution.

Brnovich chastised Clarke and the DOJ in his letter for wasting their resources "to oppose a common sense statute," while the Biden administration is "opening our borders to attract a torrent of illegal immigration."

Brnovich questioned the DOJ's efforts to "undermine [Arizona's] sovereignty" and "destabilize" the state's voting infrastructure.

"I really hope that is not your objective, "He took notice. "I strongly encourage you to drop this erroneous lawsuit and instead acknowledge Arizona's constitutional ability to run legal and safe elections."

The bill, according to Gov. Ducey, would address the more than 11,000 voters who did not present evidence of citizenship in 2020 in a state that President Biden won by fewer than 11,000 votes.
