Gavin Newsom Taking Another Step to Disarm Californians.

Despite the fact that crime is on the rise in California, Gov. Gavin Newsom and his legislative supporters want to make it more difficult for residents to defend themselves.

“This bill would specify that a gun industry member has created or maintained a public nuisance, as defined, if their failure to follow federal, state, or local law caused injury or death, or if the gun industry member engaged in unfair business practices,” says Assemblyman Phil Ting (D-San Francisco).

It’s an outright attempt to bankrupt gun manufacturers, and it’s a clear violation of the Second Amendment’s “right of the people to keep and bear arms.” The Supreme Court’s Heller decision in 2008 clarified that this was an individual right, not only one of a state militia. And, of course, one can only exercise a right if one has the physical means to do so.

The First Amendment right to freedom “of the press, for example, may only be enjoyed if paper businesses are not prevented from selling paper to publishers and the general public. If the “paper industry” could be sued because, say, terrorists used paper to publicize attack plans, the cost of paper would skyrocket, making the practice of “press freedom” impossible.

Newsom presented AB 1594 in response to a US Supreme Court decision that upheld a Texas law permitting private persons to sue abortion clinics for the time being. It’s far from certain that the court will uphold the law indefinitely. “If states can now insulate their laws from review by federal judges that compare assault guns to Swiss Army knives, then California will utilize that authority to safeguard people’s lives, where Texas used it to put women in harm’s way,” Newsom said in a statement on Dec. 11.

“So long as the United States Supreme Court has set a precedent which allows private citizens to sue to stop abortions in Texas, California will use that same ability to save lives.” Newsom’s spokesperson, Daniel Lopez, said in a statement Tuesday.

Actually, pro-lifers argue that abortion takes a life, and that childbirth nowadays rarely results in the mother’s death. Abortions, like all medical operations, include considerable danger, not only to the baby but also to the mother.

Guns are also directly included in the Bill of Rights, although abortion has only been recognized as a right since the 1973 Roe v. Wade ruling, which the Supreme Court may overturn or change.

“We must make our neighborhoods safer,” Ting said explaining his bill. “Almost every industry in the United States can be held liable for what their products do, but the gun industry is not held to the same standard. Financial repercussions may finally push them to be more responsible by improving their practices and adhering to California’s strict gun laws. “

That is deceptive. Industries can be held liable for product malfunctions, but not for their misuse. When a system fails and a car crashes and kills people, automobile makers are frequently sued, but not when a car is used as a weapon to kill, as in the recent killing in Kenosha, Wisconsin.

The legitimate use of guns is for self-defense, sports, and hobbies; the improper usage is to kill someone while committing a crime. To ward off an attack by a killer or rapist, justifiable kills using weapons, as well as knives and other devices, are permitted. Ting’s bill would make it more difficult for Californians to get self-defense weapons.

Another significant distinction that Newsom and Ting overlook is that Texas’ abortion prohibition only applies to abortion facilities located in the state. Clinics in other states are unaffected in any way. AB 1594, on the other hand, would affect all gun manufacturers, even those in other states.

Only California gun manufacturers would be harmed if the Texas abortion ban were applied to AB 1594. However, according to Sam Paredes, executive director of Gun Owners of California, there appear to be no more manufacturers of any size in the state. “When Weatherby left Paso Robles for Wyoming in 2018, I do believe that they were the last major firearms company left in California,” he said.

As a result, overregulation in California has resulted in the loss of even more firms and jobs.

Given that the Interstate Commerce Clause was created to prevent states from targeting each other’s enterprises through tariffs and litigation, it’s easy to see how AB 1594 would be dismissed by the Supreme Court on that basis as well.

What’s strange about this is how it fits in with Newsom’s clear presidential ambitions, either in 2024 or, more likely, in 2028. Supporting this odd proposal could help Newsom garner support from the Democratic Party’s most radical factions. As a result, it may help him advance in future party presidential primaries.

It would, however, hinder him in any national presidential campaign, particularly in pro-gun swing states like Pennsylvania, Michigan, and Wisconsin, which President Biden won in 2020. On Monday, tens of thousands of people came to the streets of Germany to protest the COVID-19 restrictions, which are slated to take effect today.

According to local sources, over 15,000 people marched to the streets across multiple cities in Mecklenburg-Western Pomerania, northern Germany, to oppose stricter restrictions.

According to Tagesschau, which quoted police estimates, roughly 3,000 people demonstrated in Cottbus. Around 9,000 people came to the streets in 16 different sites around Brandenburg in the east. According to local sources, hundreds more protested in Hesse, Baden-Württemberg, and numerous locations in Lower Saxony.

Approximately 6,500 people marched in Rostock, a city on the Warnow River on the country’s north shore, while around 2,700 people demonstrated in Schwerin, and around 2,400 people demonstrated in Neubrandenburg.

On Twitter, police in Saxony, East Germany, claimed officers were monitoring sites in Görlitz, Bautzen, Hoyerwerda, Kamenz, and Zittau.

“In Bautzen, Görlitz, Zittau, Weißwasser and Hoyerswerda, there are currently larger gatherings of people,” police stated on Monday. “Our emergency services will notify them of the existing Covid emergency restrictions and request that they leave the area,” authorities stated.

Police subsequently claimed they were assaulted during the Bautzen demonstrations.

“The emergency services were massively attacked with fireworks and bottles,” police stated later that night.

At least 10 police officers were allegedly hurt during rallies in Saxony, according to DW.

According to DW, police were also dispatched to disperse crowds in the Saxon towns of Dresden and Leipzig.

On Monday, a number of demonstrators in Schweinfurt, Bavaria, were given suspended jail sentences, while another was fined by the municipal court.

Protests have erupted across Germany in recent weeks as citizens face increased restrictions as a result of the fifth COVID-19 wave, that’s being led by the Omicron variant.

Residents are now forced to show proof of vaccination to enter non-essential stores after the government implemented a series of measures aimed at people who have not yet received vaccinations in an effort to raise vaccination rates.

Chancellor Olaf Scholz revealed the new measures in place last week, which include contact limits for even those who have been vaccinated.

According to Scholz, the administration opted to adopt additional nationwide limits after Christmas since family-oriented holidays like Christmas and Easter “have not proven to be major drivers of the pandemic”.

Starting today, Germans who have not been vaccinated against COVID-19, will be limited to meeting in groups of two, while those who have recently been vaccinated or recovered from COVID-19 will be able to meet in groups of ten.

Nightclubs will be prohibited ahead of the New Year, as well as gyms, swimming pools, and theatres (both indoor and outdoor) are limited as of today.

As of today, many restaurants and cafés will close early, and huge events such as concerts and sporting events will be staged without an audience.

“This is no longer the time for parties and social evenings in big groups,” Scholz added.

Scholz and Germany’s 16 state governors will meet again on January 7 to debate whether the restrictions should be maintained or tightened.
