The brave Marine veteran who stopped a career criminal from terrorizing passengers on a New York City subway car turned himself in Friday in lower Manhattan.
District Attorney Alvin Bragg’s office said 24-year-old Marine veteran Daniel Penny has been charged with second-degree manslaughter. Fox News reports prosecutors are “expected to ask for significant bail.”
Penny put Jordan Neely in a choke-hold after the homeless man terrorized passengers on board a northbound F train on May 1.
Neely had a lengthy criminal record – more than 40 charges – and at the time of his death there was a warrant for his arrest on an assault charge.
Attorneys for Penny offered “condolences to those close to Mr. Neely” and claimed, “Mr. Neely began aggressively threatening Daniel,” and that the Marine veteran and others “acted to protect themselves.”
Attorney Steven M. Raiser added, “We are confident that once all the facts and circumstances surrounding this tragic incident are brought to bear, Mr. Penny will be fully absolved of any wrongdoing.”
Mayor Eric Adams said at a press conference Thursday that “Jordan Neely did not deserve to die.”
Protesters have called for justice following the deadly incident. Over the weekend, protesters filled subway stations, some jumping on the tracks, while pressing for more action. Several protesters have been arrested in recent days during demonstrations.
Maria Castaño, 64, an interior designer who lives in Brooklyn, told The New York Times she viewed the man who choked Mr. Neely as a hero and Mr. Neely as the recipient of justice.
“I feel sorry for the man, but he was acting threatening,” she said.
The reason why Penny is being charged is to prevent Black Lives Matter activists and Democrats from burning down the city.
