Constitutional Rights Group Is Suing Canadian Federal Government For Unlawful Invocation Of Emergencies Act.

A constitutional rights organization has filed a lawsuit against Ottawa for invoking the Emergencies Act and blocking the financial accounts of many people who took part in recent rallies against the government COVID-19 regulations.

In a news release dated February 25, the Justice Centre for Constitutional Freedoms (JCCF) announced it had launched a constitutional challenge against the federal government on behalf of four Canadians, including two decorated military veterans and a former police officer.

On Feb. 14, Prime Minister Justin Trudeau activated the act, giving police broad new powers to expel protestors from downtown Ottawa and demonstrators who were blocking multiple Canada-US border crossings in solidarity with those in the national capital. Financial institutions were also empowered to freeze the accounts of individuals and corporations suspected of being involved in the protests without requiring a court order under the public order emergency declared on Feb. 15.

The JCCF said it will take legal action against one of the “most egregious and worrisome, unwarranted, and unjustifiable power grabs” by a democratic government in his lifetime, according to its president, John Carpay.

“The freezing of bank accounts is a blatant abuse of government power,” Carpay said. “It was used to penalize those who supported a peaceful protest for the restoration of Charter rights and freedoms that were taken away from Canadians 23 months ago.”

The protest started as a truckers’ effort called “Freedom Convoy,” which was in opposition to the federal government’s vaccine mandate forcing cross-border truck drivers re-entering Canada from the US to be fully vaccinated against COVID-19 or risk a 14-day quarantine. It quickly grew into a national movement when big truck convoys from around the country converged on Ottawa on Jan. 29 to hold a large-scale protest, with many joining to demand an end to all COVID-19 regulations and limitations.

The House of Commons passed a motion to approve the emergency measures on Feb. 21. On Feb. 23, as the Senate debated whether to follow suit, Trudeau withdrew the act.

According to Isabelle Jacques, assistant deputy minister of finance, at least 206 accounts totaling $7.8 million had been frozen by that time due to the Freedom Convoy’s support, according to a parliamentary Finance Committee meeting on Feb. 22.

The JCCF said it has retained constitutional attorneys Brendan Miller of Foster LLP and Blair Ector of Ector Law to act on its behalf and on behalf of its clients. The centre would proceed with the court case as “a matter of public interest,” trying to hold the government accountable for the decision to exercise the exceptional powers that it alleged had infringed on Canadians’ charter rights and freedoms.

“The Justice Centre’s legal action will claim that the use of the Emergencies Act was unconstitutional and an undue exercise of Executive Power, not authorized by law in the circumstances,” according to the JCCF.

Premier Jason Kenney of Alberta, the Canadian Civil Liberties Association, and the Canadian Constitution Foundation had all filed legal challenges to Ottawa’s emergency declaration. Following Trudeau’s repeal of the act on February 23, all three announced they will continue their legal battles.

Two of JCCF’s clients’ bank accounts were frozen under the Emergencies Act “without judicial authority or a review procedure, utilizing rules that ordinarily solely apply to terrorists and foreign nations,” according to the JCCF.

According to the JCCF news release, Edward Cornell, 64, a former Canadian Armed Forces warrant officer from New Brunswick, went to Ottawa on several times in January and February to support the truckers’ protest.

“I had no intention of overthrowing Canada’s democratically elected government… Cornell told the JCCF that his military record “supports my stance in standing up for democracy and democratic rights around the world.”

Cornell received the Medal of Bravery on June 15, 1987, for his bravery in dangerous circumstances while serving in Cyprus, where he saved a man from drowning. From 2013 until 2015, he worked as an auxiliary officer with the Ontario Provincial Police.

Cornell stated the protests in Ottawa were “completely nonviolent” and “festive and pleasant,” with individuals of all backgrounds, colors, and nationalities taking part in a sworn affidavit that would be submitted with the Federal Court.

Cornell was invited to assist in liaising between the police and the protestors during the demonstrations, but his activities resulted in the freezing of his bank accounts and credit cards, according to the JCCF.

Cornell said he was “left in a really desperate situation” and “unable to pay any of my bills that were due at this period,” adding that having his bank accounts taken was “traumatic.”

“Despite the fact that I had broken no laws, the government had my accounts frozen and my hard-earned money taken.” I am not a thief or a criminal. I am not a terrorist in any way. I am a retired military veteran from Canada who proudly served his nation… He stated, “I feel deceived by my own country.”

The four petitioners represented by the JCCF have requested the Federal Court to declare Trudeau’s declaration of a national emergency “unconstitutional, unjustifiable, and unauthorized by law,” according to the JCCF.

It stated that in order to declare a public order emergency, the scenario must constitute a “threat to Canada’s security,” which includes “acts of significant violence against individuals or property for the purpose of achieving a political, religious, or ideological goal within Canada.”

“This court case claims that at the time the declaration was issued, there were no grounds or facts to substantiate the existence of a real national security threat to Canada,” the JCCF stated.

Trudeau has truly outdone himself this time by pointing his finger back at his citizens, claiming that the problem is their yearning for medical autonomy. Perhaps citizens wouldn’t be disrupting the economy if globalist sell outs like Trudeau, Fauci, Newsom, Inslee, and Pelosi weren’t imposing tyrannical COVID-19 legislation on their people. These people are public servants, and will no doubt provide the public service we demand. 37% of the worlds population is being grossly neglected by public officials who seek to aid big pharma catalyze biotechnological innovation. This agenda inherently defies the will of God, and will no doubt come with divine consequence.
