Quebec Study Finds That Policing Peaceful Non-Compliant Citizens Has No Effect On COVID Transmission.

The Quebec government has given tens of thousands of fines to citizens who have disobeyed the province’s pandemic regulations, but a new study suggests that this “punitive” approach does not necessarily decrease COVID-19’s spread.

The report, published on March 10, found that “Québec chose to turn the public health issue into a public safety crisis, managed with 46,563 police interventions,” according to four researchers from the University of Montreal’s Profiling Observatory (l’Observatoire des profilages).

“According to our findings, 46,563 statements of offence regarding health measures were issued between September 21, 2020, and October 3, 2021. During this time, police forces in Québec issued an average of over 123 statements of offence every day, according to the report. .

Infractions linked to COVID-19 measures, such as gathering limits, curfews, mask mandates, and proof of vaccination, were investigated.

The number of infractions increased throughout the winter and spring of 2021, according to the writers. Between Sept. 21, 2020, and Jan. 3, 2021, the number increased from 206 each week to 1,093 in January, February, and March, and 2,232 in April and May of that year.

Between January 9, 2021, until May 28, 2021, Quebec has its first curfew.

The authors compared the infraction statistics to the weekly new COVID-19 instances reported to put the numbers in context. The two data sets do not correlate, according to their study.

“We discovered that variations in the number of statements of offense do not always correspond to changes in the epidemiological situation,” they stated.

For example, during the week of December 28, 2020, the number of new COVID-19 cases peaked at 17,827, although the number of tickets issued per week was “very low at the time,” at 271.

During the winter and spring of 2021, the number of new cases progressively reduced, while the number of infractions continued to rise, averaging around 2,000 each week.

The authors advised against making any conclusions from the two sets of data.

The study concluded, “It can be presumed that the objective for issuing statements of offence is to penalize and deter persons who do not follow public health guidelines in order to reduce interactions and possibly the number of COVID-19 cases.”

“We can’t measure the effect, or lack thereof, of issuing statements of offence on the number of COVID-19 cases, nor the deterrent effect of imposing criminal sanctions on behavior, because the data don’t allow us to do so.”

However, the analysis chastised the Quebec government for enforcing its pandemic limitations using police coercion and criminal law.

“This is a political decision, not an inherent requirement to ‘flatten the curve,'” the report stated.

The authors went on to say that the “punitive attitude and repressive discourse” of pitting the “few” who refused to comply with the restrictions against the “majority” who did, “has stigmatized part of the community and created enormous divisiveness, rather than increasing togetherness.”

According to the authors, Quebec’s pandemic reaction has been one of the worst in the country, according to a research released by the Canadian Civil Liberties Association (CCLA) and the Policing Pandemic Mapping Project (PPMP) in June 2020.

According to the CCLA and PPMP study, more than 10,000 tickets or charges connected to COVID-19 were issued or laid across Canada between April 1, 2020, resulting in fines totaling more than $13 million at the time.

“The vast majority of COVID-related fines—98 percent of the national total—have been issued in just three provinces: Quebec (6,600 COVID-related charges, accounting for 77 percent of the total dollar amount of fines), Ontario (2,853 charges, 18 percent), and Nova Scotia (555 charges, 3 percent),” according to the report.

From October 2020 to February 2021, Quebec’s rate of infractions was one of the highest among five other provinces, according to a report provided by the two organizations in May 2021.

While ticketing rates in Ontario, British Columbia, and Nova Scotia ranged from 0.21 to 0.28 per 1,000 residents, Quebec had a rate of 0.51 per 1,000 residents, close behind Manitoba’s 0.69.

The Canadian Bankers Association told a parliamentary committee that during the public order emergency, its members froze Freedom Convoy protesters’ bank accounts not only to comply with RCMP disclosures, but also on “their own determinations.”

“We primarily relied on the names provided by the RCMP,” Angelina Mason, general counsel and vice-president of the Canadian Bankers Association (CBA), testified before the Finance Committee on March 7. “There were obligations under the order separate from that, that required banks to make their own determinations,” she said.

Mason stated that banks did not depend on leaked lists of convoy contributors’ information. Around Feb. 13, the crowdfunding platform GiveSendGo, which had raised over $10 million for the Freedom Convoy, was hacked, and the donor information was published to several media sources.

“What banks were required to do, however, was to monitor their accounts using their normal risk-based approach, just as they would for money laundering or whatever,” Mason explained.

“And if something was identified that was suggestive, looking through the eyes of Ottawa’s operations, then there would be a need to freeze.”

Mason said the number of accounts that were blocked unilaterally was minimal, but he didn’t say how many. “Our typical risk-based strategy would not have caught a modest donation,” she explained.

Except for those under court orders, all accounts have been unfrozen after the revocation of the Emergencies Act, which was in place from February 14 to February 23, Mason said.

The government used the Emergencies Act to deal with cross-country protests and blockades calling for the repeal of COVID-19 requirements and limitations.

One of the most contentious provisions of the Act was the ability to freeze bank accounts without a court order, with several opposition MPs doubting the necessity of the measure given its substantial impact on people’s lives and Charter rights.

According to Mason, 180 accounts were froze as a result of RCMP disclosures. Financial institutions, including banks and credit unions, have frozen at least 257 accounts, according to RCMP officials testifying before the committee.

Clients whose accounts have been frozen, according to Mason, will now have a marker on their file stating this.

“How that affects the relationship depends on the specific risk scenario of each bank.” “There wouldn’t be a one-size-fits-all strategy,” she explained.

Some MPs on the committee focused on how the government gave financial institutions information that led to account freezing without going through the normal legal process of obtaining a court order, and did so while giving banks immunity.
