What is ‘martial law’
In simple terms, martial law is the replacement of civil rule with temporary military authority in a time of crisis. While its imposition is rare, the United States does have several noteworthy instances where martial law came into play, including in times of war, natural disasters and civic disputes.
Though there is no precise definition of martial law, the precedent in the United States holds that under it, “certain civil liberties may be suspended, such as the right to be free from unreasonable searches and seizures, freedom of association, and freedom of movement. And the writ of habeas corpus [the right to a trial before imprisonment] may be suspended,” according to a legal journal.

The mob’s destruction or removal of statues appears an attempt to erase the history of the United States and to treat great men such as Abraham Lincoln, who abolished slavery, George Washington, first president of the United States or Thomas Jefferson, third president of the United States and author of the Declaration of Independence as if they were irredeemably despicable. What they are doing looks like just an old-fashioned power-grab. The first law of power-grabbers is that if no one stops them, they keep on going — often with catastrophic consequences.
“Why do I even worry about some silly little statues coming down or some silly little street names changing?” asked Elizabeth Rogliani, who lived through Venezuela’s transition to communism.
“[W]hen I was living in Venezuela. Statues came down — Chavez didn’t want that history displayed. And then he changed the street names. Then came the [school curricula]. Then some movies couldn’t be shown, then certain TV channels, and so on and so forth…
“We didn’t believe it could happen to us. Most Venezuelans — Cubans warned us — and we were like, ‘This is Venezuela, we know about freedom. That’s not going to happen here.’ Yet it happened. And there are literally a lot of people wanting to destroy the U.S.”
Georgia governor Brian Kemp (R) has declared a state of emergency and authorized the deployment of 1,000 National Guard troops due to a sharp increase in violent crime and property destruction in the city of Atlanta.
Five people were killed in shootings over the Fourth of July weekend, including an 8-year-old girl who was shot dead inside a car during a BLM protest. 30 more were wounded over the holiday weekend.
The National Guard troops will be dispatched to three locations in the city: The state Capitol, which has been the focus of protests over statues of segregationists and Civil War leaders; the Governor’s Mansion in Buckhead; and the recently-vandalized Department of Public Safety building in southeast Atlanta.
The governor’s aides earlier Monday said his emergency powers grant him the authority to deploy Georgia National Guard troops to Atlanta’s streets. He took that step in late May, after widespread looting and violence, at Bottoms’ request. –AJC
“Peaceful protests were hijacked by criminals with a dangerous, destructive agenda. Now, innocent Georgians are being targeted, shot, and left for dead,” said Kemp. who threatened on Sunday to “take Action” if Atlanta Mayor Keisha Lance Bottoms couldn’t control the unrest, according to AJC.
The actual words martial law will probably never be used.
The first thing you will likely see is a declaration of a “State of Emergency”. This may be done nationally, in cases of war or large-scale terrorist attacks; or it may happen locally, as witnessed in the wake of Hurricane Katrina.
In August of 2005, New Orleans was declared a disaster area, and a state of emergency was declared by the governor. This allowed state officials to order evacuations and forcefully remove residents from their homes, suspend certain laws, confiscate firearms, and suspend the sale of items like liquor, firearms, and ammunition.
In the aftermath of Hurricane Katrina, New Orleans police, the U.S. Marshals office, and the Louisiana National Guard forcibly confiscated over 1,000 legal firearms from law-abiding citizens.
Depending on the reasons behind the declaration you may also see:
- The suspension of the Constitution, probably starting with the first and second amendment.
- Confiscation of firearms; it has happened and it will happen again.
- Suspension of Habeas corpus: Imprisonment without due process and without a trial.
- Travel Restrictions, including road closures and possibly, even quarantine zones.
- Mandatory Curfews and Mandatory Identification.
- Automatic search and seizures without a warrant.
When can Martial Law be enacted?
When Martial Law can be enacted is a pretty touchy subject, largely because our founders never intended the federal government or a standing army be permitted to take such actions. Unfortunately, most people accept these unconstitutional activities and are more than willing to give up their essential liberties in exchange for peace of mind and not having to think for themselves.
This is something Benjamin Franklin warned about when he famously wrote,
“Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.”
How likely is martial law in the United States?
Let’s face it, this country is a ticking time bomb. From widespread social unrest, crime, and violence to a growing national debt which includes an entire subset of our population that depends on government assistance to exist, the writing is on the wall: Trouble is Coming.
In my opinion, we are already under a form of martial law. The founders never intended standing armies policing the citizens of the United States; sadly that is exactly what we have.
Drones, armored vehicles with high power weapons, tanks, and battlefield helicopters are no longer something that you see on some foreign battlefield; it’s now standard operating procedure at police stations throughout the country. Our federal government has poured billions of dollars into militarizing and taking over our country’s local police forces, in what can only be described as a domestic military force or standing army meant to enforce federal law.
