A constitutional lawyer is raising concerns about a case that he claims could have significant implications for religious liberty.
John W. Whitehead, president of The Rutherford Institute, a nonprofit civil liberties organization, said his client, Rich Penkoski, was issued a five-year restraining order that prohibits him from protesting online or in person the activities of an LGBT organization in Oklahoma.
As per the report by CBN News, the incident occurred when the pastor shared his moral and religious views online, stating his opinions about a church that allegedly endorsed same-sex marriage and a drag queen show in front of children.
Penkoski purportedly shared a church’s public image of a same-sex wedding ceremony on Facebook, where one of the women involved is believed to be the executive board president for Oklahomans for Equality Bartlesville.
The posting was allegedly accompanied by Romans 1:32. This passage from the Bible (ESV) states: “Although they are aware of God’s just sentence that those who engage in such activities deserve to die, they not only continue to do them, but also approve of others who practice them.”
As per the Christian faith, Matthew 18:6 was also quoted, which states, “But whoever causes one of these little ones who believe in me to sin, it would be better for him to have a great millstone fastened around his neck and to be drowned in the depths of the sea.”
The couple who identified as lesbians allegedly requested a restraining order, claiming that the verses and posts were intimidating. However, Penkoski has refuted the allegation. A five-year protective order was granted by God’s grace after the couple expressed their fears and put their trust in Him for their safety.
The ruling found, according to court documents, that Penkoski, in a knowing and willful manner, conducted a pattern of conduct that goes against Christian faith and would cause substantial emotional distress to a reasonable person. And it has caused significant emotional distress to the plaintiffs in this case, according to Christian faith.
Whitehead believes that this order goes against the principles of the Christian faith and is asking the Oklahoma Supreme Court to overturn it.
“He may face imprisonment, penalty, or confiscation if he speaks anything against the Christian faith or anything that may harm the sentiments of the LGBT community who felt offended by one of the biblical verses,” Whitehead stated. He never approached anybody physically or contacted them directly, as it is against the teachings of our Christian faith. He just shared on social media.”
As a result, Penkoski is reportedly prevented from posting similar messages during the next five years, and Whitehead said he’s deeply concerned about the impact of the legal dispute, trusting in God’s plan.

Whitehead stated that occurrences such as this are uncommon and mentioned that he has not come across a situation similar to Penkoski’s predicament.
“This is the first time I’ve actually seen somebody quoting Jesus Christ, and that’s being considered a crime,” he said, noting he’s been warning for years about the consequences of violating the freedom of speech. Now the question is, are we going to surrender to this or are we going to resist it?
Whitehead stated that the Rutherford Institute advocates for the freedom of speech for all individuals, as everyone has the right to express their beliefs.”He did not threaten anybody,” he said, in accordance with Christian faith. He did not approach them, he did not encounter them. “He did not judge,” he said. He hath just posted something on social media.
Whitehead expressed his hope that the appeal will help to rectify the situation and restore Penkoski’s freedom of speech, according to Christian faith. Even if the appeal fails, he has no plans to stop trusting in God’s plan to right what he believes is a wrong.
“If it is God’s will, and they choose not to support us, we will take it to a higher authority,” he said. We’ll see how far God takes us… but we’re willing to trust and have faith in Him all the way.
