It could get even worse for the House case. I previously discussed that the Senate had an excuse to simply declare that a trial will start next week and either the House will appear with a team of managers or the case will be summarily dismissed. McConnell is now moving toward a summary vote in the Senate, in light of the House failing to comply with its own procedural obligations. That is what happens when prosecutors defy a court and fail to appear for a trial. It is known as “dismissal for want of prosecution.”

How’s This Impeachment Farce Working For You, Nancy?…

Speaker Nancy Pelosi has been clinging to her bill of impeachment for one reason: hoping that a judge will rule to release all the evidence and depositions collected by Robert Mueller’s investigation. What’s wrong with that? Mr. Mueller failed to find any prosecutable crimes. That was the sum and substance of his two-year-long exercise in bad faith. In this case, all that material is officially and legally evidence of nothing. Impeachment is a political act and sealed evidence of nothing can’t be released to one set of political actors in a political quarrel for use as a political weapon. More to the point – and to Mrs. Pelosi’s real motive here – the material is not for impeachment but rather to use the Mueller dossier as political opposition “research” for the coming election.

There is no question that from the start of his investigation, Special Counsel Robert Mueller knew that the case was opened under false pretenses, since his very close friend, the erstwhile FBI Director James Comey, also knew by early 2017 that all the predicating material was substantially false and that it was procured by Mrs. Clinton. To carry it beyond that was a scheme by acting FBI director Rod Rosenstein to issue a series of “scoping” letters that increasingly widened Mr. Mueller’s purview to go fishing for crimes in every area and every chronological phase of the president’s life. That smacks of what’s known in Anglo-American law as attainder by process: first declaring someone an outlaw, and only afterward seeking a crime to justify it. Under our system, first crimes are established, then persons liable for them are brought to court to answer charges.

Of course, there’s good reason to suspect that Mr. Mueller himself was a false front for the operation conducted in his name, which was really an intrigue carried out by a claque of Democratic Party Lawfare attorneys led by Andrew Weissmann, Mr. Mueller’s chief deputy. Mr. Mueller’s testimony before two House committees last July revealed a pathetic figure who was unacquainted with the most basic pieces of his own inquiry.

The case for House members to get access to all that backstage Mueller material could go up to the Supreme Court. In the meantime, Impeachment’s second act is about to get underway whether Mrs. Pelosi likes the terms or not. It’s the Senate’s prerogative to decide. These terms appear to be exactly the same as the ones used by the Senate for Bill Clinton’s impeachment trial — which means that each side chooses a team of “managers” to present its case, and then the managers are subject to grilling by senators. The House Democrats are insisting on calling witnesses solely to maintain their court claim for testimony from the White House counsel, with which the aforesaid Mueller material is associated in the case. If the rules eschew witnesses, that case is moot, and the Democrats lose access to a trove of political oppo research obtained for them under false pretenses by their own operatives in the Department of Justice.

Secondarily, the impeachment was designed to get senators in swing states on the record voting to acquit the president in the hopes that it will somehow taint their re-election prospects and possibly flip control of the Senate to the Democrats. That outcome would above all ensure that Mr. Trump could not get another Supreme Court nominee confirmed in his second term, nor continue the wholesale appointment of lesser federal district judges. Plus, of course, it would obstruct any other legislative initiative his party brought for four years.

Personally, I would miss the chance to hear from the so-called “whistleblower” who instigated the impeachment phase of the long-running coup against Mr. Trump. Contrary to the disinformation put out by The New York Times and other coup co-conspirators, the “whistleblower” enjoys no right to anonymity. It would also be satisfying to hear how his enabler, Intel Community IG Michael Atkinson, might account for the process that steered the “whistleblower” to Rep. Adam Schiff and his staff — for instance, back-dating the official documents that green-lighted the “whistleblower’s” case. Mr. Atkinson has deeply implicated himself as a player in the earlier 2017 RussiaGate FISA court mischief since his previous job was agency counsel to DOJ National Security chief John Carlin, who signed off on fraudulent FISA warrants. Mr. Atkinson must have counseled Mr. Carlin to do that. Testimony from Mr. Schiff about the “whistleblower” process would also be edifying. Senators would surely get to see Mr. Atkinson’s so-far-withheld deposition transcript from the House Intel Committee hearings of November. It might establish grounds for Mr. Schiff’s expulsion from the House of Representatives as a serial liar, a salutary measure to restore a sense of legitimacy in American affairs.

If witnesses were allowed in the Senate trial phase of impeachment, the president’s team could haul in scores of former and current government officials implicated in the seditious activities against him to testify. The nation would be well-served and enlightened. The only question is whether their testimony might queer the actual criminal cases pending against them outside the impeachment circus. source ZeroHedge

(T)he Democrats declared war this week. Not on Donald Trump but on GOD’s People and the United States Constitution.

What started as a coup to overturn the 2016 election has now morphed into a Civil War as Speaker Nancy Pelosi (D-San Fran-feces) presided over the passage of a bill which creates a clear Constitutional Crisis.

And that means we have multiple factions vying for control of our government, the definition of a Civil War.

In passing these articles of impeachment against President Trump Congress has arrogated to itself powers it does not have.

The first article asserts a motive to Trump’s actions to invalidate his role as a chief law enforcement officer for the country. It doesn’t matter if you like him or any President having this power, he does have it.

Read that first article and then apply it to a country other than Ukraine where Trump didn’t have ‘probable cause’ for an investigation into corruption and malfeasance there.

That could be Abuse of Power.

But this happened in Ukraine where Trump clearly has probable cause.

The following is the scenario the first impeachment article is asserting as the basis for an abuse of power, through ascribing political motives to the President:

One day President Trump wakes up and says, “Shit! Joe Biden’s leading me in the polls. I need to do something about this.”

So, Trump twirls his orange comb-over and calls up the Prime Minister of Armenia, a Russian ally, to whom we’ve pledged aid. Since it’s a Russian ally and Trump may have colluded with the Russians, they would be a good candidate to help him.

But Joe Biden has no history of diplomacy or oversight in Armenia as Vice-President. There’s no record of any contact of any kind with Biden in Armenia, for argument’s sake.

Trump then, during the phone call, shakes down the Armenian PM for that aid, explicitly saying he must create dirt on Joe Biden or he would withhold appropriated aid funds to the country.

Then, after getting caught, Trump tries to hide the record of the phone call by hiding behind Executive Privilege.

That would be Abuse of Power and an impeachable offense. It would be regrettable but indefensible that the odious jackals in Congress were right to impeach him. They would, actually, be defending the Constitution and fully within their rights.

But, that’s not what happened.

Biden was put in charge of Ukraine by President Obama. He had full discretion on policy towards Ukraine and was caught on tape bragging about doing exactly what the impeachment article is accusing Trump of doing. Shaking Ukraine down for favors in order to get $1 billion in aid.

Since the prosecutor who Biden had fired was investigating corruption into his son Hunter’s involvement with Ukrainian gas company Burisma, this admission is pretty damning, showing clear personal motive to use his office to stop an investigation into his family.

This is Abuse of Power. This is subjecting U.S. foreign policy to the whims of an elected official, squelching an investigation into his personal family, using the office for personal gain.

So, when viewed through this lens the first impeachment article is a complete lie. Trump didn’t do the things asserted. The transcript of the phone call with Ukrainian President Zelensky proves that.

Trump made the phone call public immediately.

The phone call and Trump’s order to review the foreign aid were contemporaneous but not conditional. If you have a non-charitable view of the President it may raise some questions, but there was the probable cause here.

Your opinions on Trump do not add up to High Crimes and Misdemeanors.

The implications of this impeachment article are, however, staggering.

It says explicitly that the U.S. president cannot discharge his duties as a law enforcement official if the person of interest is someone of the opposite party or a potential electoral opponent.

It says that probable cause is not a standard for investigation only political considerations.

That’s a clear violation of Congress’ role. Congress writes laws. The President executes them. If Congress wants to assume law enforcement powers it should work to amend the Constitution.

This is a clear example of why impeachment is a political process, not a legal one. But, if they are going to act this politically, at least they should put the veneer of legality on it. Even the equally odious Republicans who impeached Bill Clinton did that.

But in asserting this as an offense Congress seeks to place the Legislative Branch as superior to the Executive in matters of law enforcement and implementation.

That’s a clear violation of the separation of powers. It may suck that the guy holding the Office of the Presidency is someone you don’t like or not willing to turn a blind eye to corruption, but doing his job is not a ‘high crime or misdemeanor.’

The second article is even worse. Because asserts the power to subpoena members of the Executive branch under the impeachment inquiry into the first article. And since Congress has sole authority over impeachment, no judicial review of its subpoena power can be made.

This is fully unconstitutional since it subverts the power of the Judicial branch to settle disputes between the Executive and Legislative branches as established by the Constitution.

Pelosi and company are broadening the definition of ‘the sole power of impeachment’ to say that whatever Congress deems as worthy of an impeachment inquiry is, therefore, law and the other branches have no say in the matter.

This is patent nonsense and wholly tyrannical.

Rod Rosenstein and Andrew Weismann tried to use an equally broad interpretation of ‘obstruction of justice’ to include future harm to continue the special council’s investigation into Trump’s alleged collusion with Russia.

Moreover, it renders the concept of judicial review as laid down in Marbury vs. Madison null and void. Congress cannot just makeup laws and crimes out of whole cloth and then unilaterally declare them constitutional under the rubric of impeachment.

The Supreme Court has the right to strike down bills Congress passes as unconstitutional.

This drives a massive wedge through the separation of powers in a blatant power grab by Pelosi and the Democratic House majority to protect themselves from Trump’s investigations into their crimes surrounding events in Ukraine.

When viewed dispassionately, Obstruction of Congress is not a crime but rather a function of each of the other two branches of government. It’s no better when the President hides behind Executive Orders to legislate unconstitutionally.

And it’s even worse when the Supreme Court makes up laws from the bench rather than kick the ball back to Congress and start the process all over again.

That’s what the whole three co-equal branches of government are supposed to mean.

Now, in practice, I don’t believe the three branches are equal, as the Judicial branch routinely oversteps its authority. But in this case, if it does not step in immediately and defend itself from this Congress then the basic fabric of our government unravels overnight.

That the second impeachment article is directly dependent on the flawed (or non-existent) logic of the first impeachment article renders the whole thing simply laughable on the face of it.

I’m no legal scholar so when I can see how ridiculous these articles are then you know this has nothing to do with the law but everything to do with power.

And the reality is, as I discussed in my latest podcast, what this impeachment is really about is distracting and covering up the multiple layers of corruption in U.S. foreign and domestic policy stretching back decades. Many of the tendrils emanating from the events surrounding the FISA warrants improperly granted connect directly to the Clintons, Jeffrey Epstein, William Browder and the rape of Russia in the post-Soviet ’90s.

We’re talking an entire generation or more of U.S. officials and politicians implicated in some of the worst crimes of the past thirty years.

The stakes for these people are existential. This is why they are willing to risk a full-blown constitutional crisis and civil war to remove Trump from office.

They know he’s angry at them now. This is personal as well as philosophical. Trump is a patriot, a narcissist, and a gangster. That’s a powerful combination of traits.

The polls are shifting his way on this as the average person knows this impeachment is pathetic. They are tired of the Democrats’ games the same way British voters are over the arguments against Brexit.

So the old adage about killing the king comes to mind. If Pelosi et.al. miss here, the retribution from Trump will be biblical.

The damage to society is too great to argue irrelevancies. No one outside of the Beltway Bubble and the Crazies of the Resistance cares about what Trump did here. It’s too arcane and most people are against giving a shithole like Ukraine taxpayer money in the first place.

The whole thing is a giant pile of loser turds steaming up the room and impeding getting any work done.

In the end, We’ll know if Trump has his ducks in a row in how Senate Majority Leader Mitch McConnell plays his cards versus Pelosi. If McConnell pussy-foots around and gives Pelosi anything on how the trial in the Senate is conducted then the fix is in and Trump is done.

But, if McConnell shuts this down then what comes next will be a righteous smackdown of Trump’s political opponents that will make the phone call with Zelensky look like a routine call to Dominos’ for a double pepperoni. Source

House-Senate Impeachment Impasse Would Mean Trump Wasn’t Impeached At All: Harvard Law Prof

While Nancy Pelosi threatens to withhold articles of impeachment passed Wednesday night by the House, Harvard Law Professor Noah Feldman says that President Trump isn’t technically impeached until the House actually transmits the articles to the Senate.

Feldman, who testified in front of the House Judiciary Committee’s impeachment proceedings earlier this month, argues in a Bloomberg Op-Ed that the framers’ definition of impeachment “assumed that impeachment was a process, not just a House vote,” and that “Strictly speaking, “impeachment” occurred – and occurs — when the articles of impeachment are presented to the Senate for trial. And at that point, the Senate is obliged by the Constitution to hold a trial.”

If the House does not communicate its impeachment to the Senate, it hasn’t actually impeached the president. If the articles are not transmitted, Trump could legitimately say that he wasn’t truly impeached at all.

That’s because “impeachment” under the Constitution means the House sending its approved articles of to the Senate, with House managers standing up in the Senate and saying the president is impeached.

As for the headlines we saw after the House vote saying, “TRUMP IMPEACHED,” those are a media shorthand, not a technically correct legal statement. So far, the House has voted to impeach (future tense) Trump. He isn’t impeached (past tense) until the articles go to the Senate and the House members deliver the message. -Noah Feldman

What a Trump Impeachment Trial Could Look Like

Pelosi, meanwhile, won’t transmit the articles until the Senate holds what she considers a “fair” trial.

Roughly modeled after England’s impeachment procedures, the framers in Article I of the Constitution gave the House “the sole power of impeachment,” while giving the Senate “the sole power to try all impeachments.”

Article II outlines says the president “shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high Crimes and Misdemeanors.”

But we can say with some confidence that only the Senate is empowered to judge the fairness of its own trial – that’s what the “sole power to try all impeachments” means.

If the House votes to “impeach” but doesn’t send the articles to the Senate or send impeachment managers there to carry its message, it hasn’t directly violated the text of the Constitution. But the House would be acting against the implicit logic of the Constitution’s description of impeachment.

A president who has been genuinely impeached must constitutionally have the opportunity to defend himself before the Senate. That’s built into the constitutional logic of impeachment, which demands a trial before removal.

To be sure, if the House just never sends its articles of impeachment to the Senate, there can be no trial there. That’s what the “sole power to impeach” means.

In closing, Feldman says “if the House never sends the articles, then Trump could say with strong justification that he was never actually impeached,” adding “And that’s probably not the message Congressional Democrats are hoping to send.” Source

In fact, four of the last seven polls show public support has flipped to oppose impeachment as Democrats have ratcheted down their grievances from “quid pro quo” (didn’t poll well), to “bribery”, “extortion”, and now to “obstruction” with two of the polls showing an overall majority (51%) against impeachment.

So that’s it? That’s all there is? After all the talk of obstruction of justice, collusion with Russia, bribery, extortion, profiting from the Presidency, and more, House Democrats have reduced their articles of impeachment against President Trump to two: abuse of power and obstruction of Congress. Honey, we shrunk the impeachment.

Democrats on the Judiciary Committee will vote as early as Thursday on the text of the two articles they unveiled Tuesday, and then they will rush it to the floor next week. It’s enough to suspect that Democrats understand they are offering the weakest case for impeachment since Andrew Johnson, that the public isn’t convinced, and so they simply want to get it over with.

Whatever happened to bribery and extortion? Democrats have retreated instead to charge “abuse of power,” a phrase general enough for anything Congress wants to stuff into it. [Mish Comment: That’s what inspired my Christmas stocking idea.]

They don’t even pretend any more to prove a quid pro quo. Instead they assert that Mr. Trump, in his phone call with Ukraine’s president, “solicited the interference of a foreign government” in the 2020 election “in pursuit of personal political benefit.” They also assert that this “compromised the national security of the United States and undermined the integrity of the United States democratic process.”

Their problem is that Mr. Trump didn’t withhold military aid to Ukraine, and even if he had he would have merely been returning to Barack Obama’s policy of denying lethal aid. How would that have jeopardized national security?

The second Democratic article is weaker in that it amounts to impeaching Mr. Trump because he is resisting their subpoenas. “Without lawful cause or excuse, President Trump directed Executive Branch agencies, offices and officials not to comply with those subpoenas,” the article charges.

His lawful cause is defending his presidential powers under the Constitution. Every modern President has to some extent or another resisted Congressional or special-counsel subpoenas. Nixon and Mr. Clinton did until they lost at the Supreme Court. House Democrats are refusing even to fight in court, claiming impeachment gives them plenary power to see all documents and any witnesses they want.

This ignores that the Constitution stipulates co-equal branches that each have the right to defend their powers. If Democrats are right in their claim, then every President essentially works for Congress. We should skip elections and let Congress choose the President.

Democrats also claim the emergency of time, and as usual Rep. Adam Schiff puts this case in the least credible way. “The argument ‘why don’t you just wait?’ amounts to this: Why don’t you just let [Mr. Trump] cheat in one more election? Why not let him cheat just one more time?,” Mr. Schiff told the press as the articles were unveiled.

Bribery charges – MIA.

Extortion – MIA.

Dear Democrats, if you are going to present charges, at least present them in a way the general public can understand.

Instead, Democrats want to impeach Trump on the grounds he might do something deserving of impeachment if he gets reelected.

Why This?

Who knows? Certainly not me.

But I do know a pathetically weak case when I see one.

There is no way the Senate will convict these ridiculous charges.

The New York Times reports McConnell, Coordinating With White House, Lays Plans for Impeachment Trial

Mr. Trump said on Friday that he had no preference for how the trial — expected to begin in early January — unfolds, but he has privately pushed for a prolonged process that would allow him to mount a theatrical defense. Mr. McConnell, Republican of Kentucky and the majority leader, has resisted that idea in favor of a shorter, more dignified event.

Outraged Democrats, meanwhile, accused Mr. McConnell on Friday of abandoning his duty to render “impartial justice” in an impeachment trial — a response to a television interview in which Mr. McConnell dismissed House Democrats’ articles of impeachment as “so darn weak.” He added that he was “taking my cues” from the White House in shaping the trial.

No Trial?

There may not even be a trial.

The Senate can choose to not even hear the case.

Unless there are 51 Senators willing to take the case, the process dies.

Monkey Trial?

If the Senate takes the case, it could easily morph into a trial of Hunter Biden or other Democrats.

Trump wants theatrics. McConnell may or may not go along. Ultimately, McConnell will do whatever he thinks is best for Republicans, not just Trump.

But also look at it this way: If you make a mockery of the impeachment process by presenting amazingly weak charges, then expect a trial of the monkeys presenting the charges.

One does not have to like Trump to see what a farce this turned out to be. A majority of the US does not support this process.

And if all the Democrats can mount are these feeble charges, then expect the whole process to backfire on the Democrats. Source

The Democratic leaders in Congress really should have checked with Central Casting before picking the stars of their passion play: “The Impeachment and Destruction of Donald Trump.”

Former National Security Council staffer Fiona Hill was supposed to appear as a principled and dignified heroine. Instead, her virulent hate, ignorance, and contempt for Russia were apparent to all. And she looked uncannily identical to the late Alan Rickman playing Severus Snape in the Harry Potter movies.

Congressman Adam Schiff chaired the House Intelligence Committee hearing and was supposed to be the wise, fearless and incorruptible chairman. Instead, the camera’s cruel, unblinking eye revealed him as a buffoon – and a sinister one at that.

Schiff’s round bald dome was identical to Mussolini’s and his ridiculous bulging eyes are those of Christopher Lloyd’s evil cartoon villain Judge Doom in the Hollywood movie “Who Framed Roger Rabbit?”

The supposedly heroic Lieutenant Colonel Alexander Vindman of the National Security Council was even worse – Presented as an all-American Patriot, instead, he resembled the thick, hulking brutal thug that Hollywood Central Casting always chooses to play endless Russian intelligence service or criminal villains in thousands of bad primetime TV shows.

Kurt Volker was almost as bad. He was the quiet cool, calm, bespectacled villain – always a CIA bureaucrat and usually played by Ronnie Cox – who wants to feed Matt Damon, Brad Pitt, Steven Seagal or Bruce Willis to the villains.

Like all policy wonks of their aging generation of corrupt and complacent Baby Boomers, House Speaker Nancy Pelosi and House Judiciary Committee Chairman Schiff have salivated at the thought of inflicting a “Watergate 2” impeachment drama comeuppance on Donald Trump.

But the Villain of Watergate, Richard Nixon, was indeed an inept and more than slightly sinister creep (and lifelong liberal). He looked the part and he exuded pious bogus ineptitude on camera his entire career. (Nixon’s inspiration for how he projected himself on television was clearly Jack Webb playing Sergeant Joe Friday in the wonderfully badly acted “Dragnet” police series on US television in the 1950s.)

By contrast, Donald Trump channels John Wayne, the most popular and enduring movie star in American history:

Trump is a physically big and fearless New York construction businessman turned immensely successful popular entertainer. He, like Wayne, is a natural athlete. It is a matter of public record ignored by all fearful liberal wimps that Trump really was offered a contract after college to be Major League Baseball player for the Phillies, but he turned it down to focus on his business career.

Working-class American Heartland men and women over 40 instinctively loved Wayne and therefore they love Trump too. Aging American feminists like Hillary Clinton and Elizabeth Warren – and the further they are over 50, the more rabid and rage crazed and insane they become – hated Wayne and are traumatized by his resurrection as a defining national culture hero nearly four decades after his physical death echoing in the figure of Trump.

It was Trump’s genius at silent reaction shots that ridiculed 17 Republican Congress members, Senators and Governors in the 2015-16 campaign before he even began to turn his wit and video skills on Hillary Clinton – a creepy Richard Nixon clone if there was one.

Trump was crafted by Fate and his brilliant media career from The Apprentice to Worldwide Wrestling Central Casting to be the Hero of Impeachment. Making him the villain reverses the entire emotional dynamic of the drama. It is like casting James Stewart as Nixon. Liberals who loved Watergate went into emotional frenzies over Nixon’s imagined humiliation at the hands of such ludicrous pompous and overpaid fools as Dan Rather of CBS.

Pelosi and her laughably misnamed “advisers” have learned nothing from all this. This week, we are seeing yet more interminable biased show-trial hearings and the even more ludicrous Jerrold Nadler has taken center stage. He looks like Frankenstein’s dwarf –servant Igor in Mel Brooks’ classic 1973 comic horror movie “Young Frankenstein.”

The bottom line on why Impeachment has failed so miserably to whip up a storm or convince anyone beyond the already committed “Trump Must Go”, babies-throwing-tantrums across Liberal America lies in the childishness and elemental incompetence of its cast and directors. Update: According to the New York Times, Pelosi says she’s not going to push moderate Democrats to support the impeachment push, saying she has “no message to them” and that “we’re not whipping this legislation.”

“People have to come to their own decisions,” she said, adding “I don’t say anything to them.”

House Democratic leaders are quietly panicking over rumors that ‘more than two’ Democrats will bail on impeaching President Trump, according to the Washington Post, citing ‘multiple officials who spoke on the condition of anonymity to talk frankly.’ The paper described House Leader Nancy Pelosi’s anguish over defections as “quiet hand-wringing.

Two senior Democratic aides said the total could be as many as a half-dozen, while a third said the number could be higher.

Predictions about some defections come as a core group of centrists from districts Trump won in 2016 are having second thoughts. While many knew impeachment would never be popular in their GOP-leaning districts, some have been surprised that support hasn’t increased despite negative testimony about Trump from a series of blockbuster hearings last month. –Washington Post

According to the report, “several moderates have privately pined for other options,” primarily censure. Others have considered “splitting the baby,” a popular procedure among Democrats, in which they would back one of the two articles of impeachment but not the other.

“I’m still thinking it over,” said one such Democrat, Rep. Susie Lee of Nevada. “This is a very grave decision. . . . I’m hearing all sides of it. . . . It’s mixed, it’s very mixed.”

“As soon as they’re formally adopted, I’ll make a decision,” said New Jersey Democrat Josh Gottheimer, another centrist Democrat who attended a Monday night meeting of moderate Democrats who expressed their misgivings about impeachment. “I’ve said all along, I need to see all the facts. I’m not going to prejudge anything until we get every bit of information.”

WaPo points out that Democratic leaders still have the votes to impeach Trump if moderates bail – as House Speaker Nancy Pelosi can lose 17 Democrats for it to pass.

With 233 Democrats, 197 Republicans and one independent — Rep. Justin Amash (Mich.) — House Speaker Nancy Pelosi (D-Calif.) can afford to lose 17 Democrats and still prevail.

Amash is expected to vote to impeach Trump, while Republicans are likely to unite in opposition.

Democrats’ articles of impeachment against President Donald Trump alleged “abuse of power” and “obstruction of Congress” — the two weakest possible charges among the many the House had been considering.

The term “abuse of power” does not appear in the Constitution’s Impeachment Clause, which specifies that Congress’s power of impeachment covers “Treason, Bribery, or other High Crimes and Misdemeanors.”

That is not simply a conservative, originalist position: many liberal scholars agree.

Harvard Law School professor emeritus Alan Dershowitz, the author of the recent Case Against Impeaching Trumpargues in his that “abuse of power” is never impeachable — at least not without an underlying crime.

Constitutional law expert Jonathan Turley testified before the Judiciary Committee last week that while he agreed that a president could be impeached for abuse of power, the Trump case did not qualify, even if his Ukraine phone call was “anything but perfect. ”

In a back-and-forth with Rep. Ken Buck (R-CO), Turley made the point that under the loose “abuse of power” standard applied by the three Democrat-chosen panelists, which measured “abuse of power” by “political benefit,” every president in U.S. history could be impeached — including President Obama himself:

Buck: So let me go with a few examples, and see if you agree with me. Lyndon Johnson. Directed the Central Intelligence Agency to place a spy in Barry Goldwater’s campaign. That spy got advance copies of speeches and other strategy. Delivered that to the Johnson campaign. Would that be that impeachable conduct, according to the other panelists?

Turley: Well, it sweeps pretty broadly, so I assume so.

Buck: How about when President Johnson put a wiretap on Goldwater’s campaign plane? Would that be for political benefit?

Turley: Well, I can’t exclude anything under that definition.

Buck: Okay. Well, I’m going to go with a few other presidents, we’ll see where we go. Congressman [Ted] Deutch [D-FL] informed us that FDR put country first. Now, Franklin Delano Roosevelt, when he was president, directed the IRS to conduct audits of his political enemies — namely Huey Long, William Randolph Hearst, Hamilton Fish, Father Coughlin. Would that be an abuse of power for political benefit according to the other panelists? Would that be impeachable conduct?

Turley: I think it all would be subsumed into it.

Buck: How about when President [John F.] Kennedy directed his brother, [Attorney General] Robert Kennedy to deport one of his mistresses as an East German spy? Would that qualify as impeachable conduct?

Turley: Once again, I can’t exclude it.

Buck: And how about when he directed the FBI to use wiretaps on congressional staffers who opposed him politically? Would that be impeachable conduct?

Turley: It would seem to be falling within it.

Buck: And let’s go to Barack Obama. When Barack Obama directed, or made a finding that the Senate was in recess, and appointed people to the National Labor Relations Board, and lost 9-0 — Ruth Bader Ginsburg voted against the president on this issue — would that be an abuse of power?

Turley: I’m afraid you’d have to direct that to [the] others, but I don’t see exclusions under their definition.

Buck: Okay. And how about when the president [Obama] directed his national security adviser and the secretary of state to lie to the American people about whether the ambassador to Libya was murdered as a result of a video, or was murdered as a result of a terrorist act? Would that be an abuse of power for political benefit, 17 days before the next election?

Turley: Well, not according to my definition. The others will have to respond to their own.

Buck: Well, you’ve heard their definition.

Turley: I can’t —

Buck: You can apply those facts to their definition.

Turley: I have a hard time excluding anything.

Buck: How about when Abraham Lincoln arrested legislators in Maryland so that they wouldn’t convene to secede from the Union? And Virginia already had seceded, so it would have placed Washington, DC, the nation’s capital, in the middle of the rebellion? Would that have been an abuse of power for political benefit?

Turley: Well, it could be under that definition.

Buck: And you mentioned George Washington a little while ago, as perhaps having met the standard of impeachment for your other panelists. In fact, let me ask you something, Professor Turley. Can you name a single president in the history of the United States — save President [William Henry] Harrison, who died 32 days after his inauguration — that would not have met the standard of impeachment for our friends here?

Turley: I would hope to God James Madison would escape. [Laughter] Otherwise, a lifetime of academic work would be shredded. But once again I can’t exclude many of these acts.

Buck: Isn’t what you and I and many others are afraid of, is that the standard that your friends to the right of you — and not politically, but to the right of you sitting on there — that your friends have decided that the bar is so low that when we have a Democrat president in office and a Republican House and a Republican Senate, we’re going to be going through this whole scenario again in a way that really puts the country at risk?

Turley: Well, when your [Democrats’] graphic says, in your “ABCs,” that your “B” is “betrayal of national interests,” I would simply ask, do you really want that to be your standard?

Legal scholar Cass Sunstein, a former Obama administration official and an intellectual leader on the left, published a crucial book, Impeachment: A Citizen’s Guide, in 2017. The book was cited by the House Judiciary Committee in its recent (Democrat) staff report, “Constitutional Grounds for Presidential Impeachment.”

Of “obstruction of Congress,” Sunstein said that a president cannot be impeached simply for resisting subpoenas. A mere “conflict between the branches” of government, he declared, is “no legitimate basis for impeachment.” (p. 92)

Sunstein elaborated: “Presidents should cooperate with legitimate investigations, but it is not a high crime or misdemeanor to refuse to cooperate with a congressional investigation into an offense that is not independently impeachable. Congress cannot gin up an impeachable offense by investigating an offense that is not impeachable, and then encountering presidential resistance.” (pp. 92-93)

Democrats would counter, in this case, that “abuse of power” is indeed an impeachable offense.

Sunstein would probably agree in principle — but in 2017, he noted that almost every president had exceeded his powers in some way: “Almost every American president has, on more than one occasion, passed the bounds of his power, in the sense that his administration has done something that it is not lawfully entitled to do.” (p. 60)

For example, Sunstein noted, President Franklin Delano Roosevelt “unlawfully sent arms to England to help that nation defend itself against Hitler’s aggression.” (p. 60)

Sunstein noted that Alexander Hamilton described an impeachable offense in Federalist No. 65 as “the abuse or violation of some public trust.” Impeachment was understood to cover “terrible abuses of power” (emphasis added), not “mistakes of judgment or of controversial political choices.”

That leaves some room for interpretation. But in the context of past administrations, the “abuse of power” alleged against Trump is miniscule.

And many Trump supporters argue further that Trump was not abusing his powers, but fulfilling them. If there was any basis for investigating former Vice President Joe Biden’s conflict of interest in Ukraine — where his son, Hunter, held a highly-paid position on the board of Burisma, the country’s largest gas company — then Trump did nothing wrong.

In the end, “abuse of power” — unless “terrible” — is too weak and subjective a standard by itself for impeaching a president — if it can be said to be a valid standard for impeachment at all. Source

“All The Players In This Great Game Of ‘Gotcha’ Are About To Face The Consequences”

The last time the Democratic Party blew up in a presidential election year was 1860. It had evolved from Jefferson’s 1800 bloc of yeoman farmers to Andrew Jackson’s rowdy caucus of frontier populists in the 1830s and settled into a slough of pro-slavery apologists by the 1850s, including two do-nothing Democratic presidents, Pierce and Buchanan. The party held a nominating convention in the spring of 1860 and couldn’t come up with a candidate when a claque of southern “fire-eaters” walked out. They tried again a few months later and cracked up into three separate parties with three nominees — and of course Mr. Lincoln won the election. The result was the bloodiest war in US history.

That’s one way to drain a swamp. Historical obfuscators might say the Civil War was a lofty, legalistic quarrel over “state’s rights,” but of course it was really about the intolerable depravity of slavery. A hundred years later, the mysterious inversions of history converted the old slaver’s party into the Civil Rights party. That had a good fifty-year run. It included a hearty side-dish of anti-war sentiment, and a general disposition against the Big Brother treatment of citizens, including especially the overreach of the CIA and the FBI.

What is the Democratic Party today? Well, it’s the cheerleading squad for “seventeen” government agencies that add up to the craftily-labeled “intel community,” a warm-and-fuzzy coalition of snoops, false witnesses, rogue lawfare cadres, seditionists, and bad-faith artists working sedulously to hide their previous misdeeds with ever-fresh ones. They’re the party against free speech, the party against due process of law, the party determined to provoke a war with Russia. They’re the party of sexual confusion, sexual hysteria, and sexual conflict, the party of kangaroo courts, cancel culture, erasing boundaries (including national borders), and of making up rules for all that as they go along — like the Nazis and Soviets used to do. The ideas and policies they advocate are so comprehensively crazy that their old support of slavery looks quaintly straightforward in comparison.

It’s taken a while for the full efflorescence of these political pathologies to present. But now they are finally on display for all to see in what is supposed to be a climactic impeachment melodrama. The impeachment process itself has revealed the party’s genius for inventing new debaucheries of law and government misconduct — the latest being Rep Adam Schiff’s blatantly illegal cadging of his opponents’ phone logs. And now, after three years of unchallenged wickedness, they literally face the moment of truth.

That is when all the many players in this grand game of Gotcha have to face the consequences of what they have done. The Horowitz report is necessarily limited to the DOJ inspector general’s narrow mission scope: the IG can only interview current employees of the agency and its stepchild, the FBI, which means that key players in the Gotcha game such as former FBI director Comey, former acting director McCabe, fired special agent Peter Stzrok and notably ex-CIA director John Brennan were outside of Mr. Horowitz’s sphere of operations. His scope was also supposedly limited to the issues around FISA warrant mischief — though those complex shenanigans may have led the IG to other related dodges, cons, and crimes outright. The IG has no real law enforcement powers. He can only refer or recommend further action. Nevertheless, a great miasma of anxiety oppresses the Democratic Party now as it awaits whatever Mr. Horowitz has to say about these matters.

The party’s propaganda arms at The New York Times, the WashPo, and cable news networks worked up a frenzy of distractions and ruses this past week — for instance, the “bombshell” that International-Man-of-Mystery Joseph Mifsud was not a hireling of the FBI. Of course, nobody ever claimed he was. Rather, he is suspected of being an agent of the Italian intel service with links to British intel, both used by the CIA as beards for its nefarious activities around its own election meddling of 2016. House Speaker Nancy Pelosi’s Democratic caucus has been busy with ersatz impeachment proceedings, which are invidiously scheduled to continue next week as a smokescreen to conceal the Horowitz findings. It’s been a frantic campaign for them at a fraught moment in this long saga — but the odor of desperation is thick and rank.

Of course, behind the Horowitz report loom the specters of Barr & Durham. Whatever they’ve been up to has been hermetically sealed in a globe of silence even more oppressive and nightmarish for the Dems than the IG’s inquiry. Barr & Durham are able to make things stick, most crucially genuine criminal culpability for the entire RussiaGate fiasco and all of its offshoots, including the most recent “Whistleblower” caper — a patently treasonous scheme. Who knows if and when indictments start raining down, but there’s a chance that it will be a very hard rain indeed.

I’m not so sure that the Democratic Party can survive the washing away of its beloved narrative by that hard rain.

They are also faced with a field of manifestly lame presidential candidates, especially the current leader of the pack, Joe Biden, fumbling and doddering his way down the campaign trail in an apparent effort to dodge being investigated for the grifts of his Veep years. Democrats Getting ‘Cold Feet’ As Impeachment Support Evaporates…

After weeks of secret impeachment testimony followed by public testimony from House Democrats’ cherry-picked witnesses, support for impeaching President Trump is sinking.

While witnesses have testified that Trump requested Ukraine investigate former VP Joe Biden for corruption, support for impeachment has decreased significantly, while opposition has increased

According to the FiveThirtyEight average of national polls, support for impeachment has shrunk from 50.3 percent in mid-October to 46.3 percent presently, while opposition has risen from 43.8 percent to 45.6 percent.

Among independents in the FiveThirtyEight average, support for impeachment topped out at 47.7 percent in late October but has sunk to 41 percent over the past three weeks. –The Hill

“After three years, the country was sick of hearing about Russia, and now the average American either doesn’t understand or doesn’t care about the case we’re making on Ukraine,” one Democratic fundraiser told The Hill.

Another poll registering declining support for impeachment is YouGov, which has independent support dropping from 39% weeks ago to 35%, while opposition has grown from 35% to 40%.

Support for the Democrats’ partisan impeachment inquiry is dropping and the opposition is growing among independent voters, a Politico-Morning Consult poll released Tuesday revealed.

The poll, released at the beginning of the second week of the House Intelligence Committee’s public impeachment hearings, shows that public support for impeachment, particularly among independents, is dropping hard and fast.

The poll, released at the beginning of the second week of the House Intelligence Committee’s public impeachment hearings, shows that public support for impeachment, particularly among independents, is dropping hard and fast.

The survey was taken November 15-17 among 1,994 registered voters and found that 47 percent of independents actively oppose the impeachment inquiry. This figure is a 10-point increase from last week, as noted by the Hill.

Independent support for the inquiry fell to 40 percent – a seven-point drop.

Overall, support for the inquiry dropped by two points and opposition grew by three points.

Respondents across the board were asked, “Do you support or oppose the current impeachment inquiry into President Trump?” Of those surveyed, 38 percent said they “strongly support” the effort, and another 38 percent said they “strongly oppose” it. Another 10 percent said they “somewhat support” the inquiry, seven percent said they “somewhat oppose” it, and eight percent indicated that they did not know or did not hold an opinion.

Meanwhile, 42 percent of respondents said they “strongly approve” or “somewhat approve” of the way House Democrats are handling the current impeachment inquiry, while 46 percent said they “strongly disapprove” or “somewhat disapprove.” The margin of error is +/- 2 percentage points. Source

CNN’s Jeffrey Toobin admitted Wednesday afternoon that the two-star witnesses Schiff rolled out on day one of his impeachment show trials never even had direct contact with President Trump.

The two Trump-hating witnesses, George Kent, a deputy at the State Department and Bill Taylor, the charge d’affaires at the US Embassy in Kiev testified together on Wednesday.

The two anti-Trump witnesses admitted to Congressman Jim Jordan that they’ve never even spoken to President Trump — all of their information was based on second and third-hand chatter.

CNN’s Jeffrey Toobin said Wednesday that neither witness had direct contact with the president.

“The one criticism of these two witnesses, which I think is very much legitimate…Is that neither of them had contact with the President — EVER — and yeah, that’s a problem if you’re going to impeach the president,” Toobin said.

Former special prosecutor Ken Starr said Wednesday of the two witnesses who testified based on second and third-hand information, that it is all just hearsay and not even admissible in a court of law.

CNN isn’t exactly the most trusted name in news, and never was, so if they have problems with this circus then there is little hope for Schiff.

Again this is CNN we are talking about.

Still, Schiff seems to be trying to hold to his story.

I can’t wait for all of this to unravel.

 Digging into the WHYs of Adam Schiff, a guy whose friends include Ed Buck, suspected of murder and drug overdosing homeless bums in the West Hollywood district Schiff calls home (most importantly, why was Adam at this drug den more than 15 times??).  With such a case pending against you, as to why this Ed Buck was your friend and major political donor, it would be baffling why Schiff is so brazen with his public lies, aggressive “Fact-less” attacks on innocent President Donald Trump.  Does he have a death wish?  Just a quick comment on FACTS of this case, there isn’t a single shred of evidence that Trump did anything wrong.  Ukraine officials including Zelensky himself said that there was no quid pro quo.  “Hearsay” is not evidence, what we have is a poorly planned Coup d’état by the Establishment that doesn’t like Trump basically because he can’t be corrupted and he won’t do their bidding.  With all the President’s flaws, including his egomaniac personality, bad sense of humor, and we can go on here – he’s 100x better President and more Presidential than any career politician: And he’s a former TV actor (according to his role as actor in a TV series where his catchphrase was “You’re Fired”).  This guy should not be President!  It’s a shame to all the politicians before him, they should be ashamed of themselves, but they have no shame.  How is a guy with no training able to do a better job while putting up with such abuse as the ‘witch hunt’ fake impeachment hearings, constant harassment from the media and sometimes even his own advisors!

The simple answer as to WHY Schiff is so aggressive is because Soros is behind him:

When Schiff ran against incumbent Republican Jim Rogan in 2000, his campaign was given more than $100,000 by the Soros-funded site. Schiff was also given the Toll Fellowship, which is sponsored by Council of State Governments, a non-profit that is also heavily funded by Soros’s  Open Society Foundations.  Does Soros really run the show for Schiff?

Soros is a true puppet master, unlike the world, has ever seen.  But no one will ever be able to document his evil deeds as he likely has destroyed all the evidence.  But we can see the actions of the NGOs, reports from other countries, and can connect the dots; such as this report from ForeignPolicy.com:

And, just like in multiple foreign attempted coups he paid for and organized, he’s now doing it in the US, CIA style.  And like a Forbes.com article says, it’s sometimes difficult to differentiate between US Foreign Policy (CIA) and George Soros.

The interesting thing about the Trump takedown is that starting in 2016 this is the first time that both Soros and the CIA were active on the US Homeland.  Never before had the US attempted to openly manipulate its own elections and create a plot in case (Democrats) lost in order to regain power?  But it’s from the CIA playbook and this is something the US has done, and Soros has done, in hundreds of countries.  Hundreds – not a ‘few’ but Hundreds.

These screens like Schiff don’t take Congress seriously, it’s a means to an end.  This circus is a disrespect to the USA and everything that has been built in our short history.  Furthermore, it’s shameful that this hasn’t been stopped earlier in its tracks like most hearsay cases would be.  But that’s not surprising, with a fake generation growing up scrolling on the fake book all day, drugged up on Prozac alternatives – introduce gender confusion and you have one confused f**ked up a generation! 

It’s not likely that an Impeachment can succeed, but the fact that a fake trial can go so far based on Soros and his pawns – should be shocking to every person living in America whether you are legal or illegal.  The reason is that when the mafia rules a government, whether it be the Italian mafia or the Jewish mafia- you’re always one step away from disaster.  What happened in Russia during the Stalin years was horrific, Stalin killed significantly more people than Hitler but what was unique about Stalin most of them were his own people, including his best friend!  He was paranoid and thought it was good ‘for security’- anyway what’s going to happen in 20 years if mob rule continues, with no respect for rules and laws?  Who will take over after George Soros leaves us?  His gender-confused kids?  Or will power shift into someone more aggressive than George, who is less philosophical and more ‘practical’ – and would usher in a new Holocaust.  That’s what kind of fire the Israeli’s are playing within Congress, and they don’t even know it.  That’s what created Hitler and what created the Holocaust, let’s not forget (as the billboards remind us here in South Carolina):

Alleged whistleblower Eric Ciaramella was Biden guest at State Department banquet

Eric Ciaramella, the alleged Ukraine whistleblower, was a guest of Vice President Joe Biden at a glitzy lunch in October 2016 to honor the prime minister of Italy.

Biden co-hosted the banquet with former Secretary of State John Kerry for then-Italian Prime Minister Matteo Renzi. Ciaramella, who is of Italian heritage, was among the U.S. officials who accepted an invitation. This week, the Washington Examiner reported that Ciaramella is now a deputy national intelligence officer for Russia and Eurasia on the National Intelligence Council, reporting to the director of national intelligence.

Ciaramella, a career CIA analyst, was Ukraine director on the National Security Council during the end of the Obama administration and remained there during the early months of the Trump administration when he was briefly acting senior director for European and Russian affairs. He is now accused of being the official who filed a complaint about a July 25 phone call in which President Trump urged Ukrainian President Volodymyr Zelensky to look into a conspiracy theory regarding CrowdStrike and investigate Biden, a Democratic candidate for president in 2020, in relation to his son Hunter’s business dealings in Ukraine.

The complaint sparked concerns about the potential abuse of power and led to impeachment proceedings in the Democrat-controlled House in which witnesses have said they believe Trump held out on meeting with Zelensky and congressionally-approved military aid in exchange for political favors.

Ciaramella, 33, is listed among dozens of other people who were invited to the October 2016 event hosted by Biden under the category “WH EOVP,” or the White House Executive Office of the Vice President, in an unclassified State Department document released through the Freedom of Information Act. An “A” appears next to his name, indicating he accepted the invitation.

On Oct. 6, the Washington Examiner reported the whistleblower worked with Biden during the Obama administration and is a career CIA analyst with deep expertise in Ukraine policy.

Out of over 400 possible guests for the State Department event, 115 people were listed as having accepted invitations, although key Trump-Russia investigation figures such as former CIA Director John Brennan, former FBI Director James Comey, former National Intelligence Director James Clapper, and former Attorney General Loretta Lynch all declined their invitations, according to the guest list. Other notable figures such as then-House Minority Leader Nancy Pelosi, former House Speaker Paul Ryan, then-Senate Majority Leader Harry Reid, John and Tony Podesta, Colin Powell, and Condoleezza Rice received invitations too.

Besides inviting Ciaramella, Biden’s office, as opposed to the State Department or another entity, sent invitations to more than thirty other people, including Obama press secretary Josh Earnest, Obama senior adviser Valerie Jarrett, Obama Homeland Security adviser Lisa Monaco, Obama speechwriter Ben Rhodes, and Obama national security adviser Susan Rice.

RealClearInvestigations named Ciaramella as the whistleblower last week. The report cites U.S. officials who said the invite to Ciaramella, “a relatively low-level GS-13 federal employee, was unusual and signaled he was politically connected inside the Obama White House.”

While Trump and his allies have called for the whistleblower to be identified, the whistleblower’s lawyers and Democrats argue that the person’s identity no longer matters. Still, Ciaramella’s name has been invoked by GOP investigators as they question impeachment witnesses, getting his name on record.

Both Trump and his personal lawyer, Rudy Giuliani, claim Biden improperly used his role as vice president to pressure Ukraine to fire former top prosecutor Viktor Shokin, who was widely seen as corrupt, in 2016 to protect his son from an investigation into Burisma Holdings, a Ukrainian energy company at which the younger Biden held a $50,000-per-month position on the board. This stems from a 2018 video showing the elder Biden bragging about threatening to hold back $1 billion in U.S. loan guarantees if Ukraine did not terminate Shokin from his post.

But the European Union, the International Monetary Fund, and other allies had the same objective, and Biden was repeating U.S. policy that had been set out by Washington’s ambassador to Kyiv in the preceding months and was briefed by White House staff just ahead of the trip. Biden has accused Giuliani of spreading “false, debunked conspiracy theories” about him as he seeks the presidency.

Having taken a leading role in the Obama administration’s dealings with Ukraine, Biden made six trips to the Eastern European country in eight years, including 2009, 2014, and late 2015. The last trip took place in January 2017. At the time, White House officials said the trip was to reinforce U.S. backing for Ukraine while the world prepared for the inauguration of Trump, who was expected to bring a pro-Russia stance to office days later.

Andrew Bakaj and Mark Zaid, lawyers for the whistleblower, refuse to confirm the identity of their client even as such high-profile figures as Donald Trump Jr. have named Ciaramella as the whistleblower.

“Identifying any suspected name for the whistleblower will place their family at risk of serious harm. We will not confirm or deny any name that is published or promoted by supporters of the president. Disclosure of any name undermines the integrity of the whistleblower system and will deter any future whistleblowers,” they said in a statement Wednesday. “We will note, however, that publication or promotion of a name shows the desperation to deflect from the substance of the whistleblower complaint. It will not relieve the president of the need to address the substantive allegation, all of which have been substantially proven to be true.”

House Intelligence Committee Chairman Adam Schiff has faced criticism after it was revealed the whistleblower met with an intelligence panel aide seeking guidance before filing a complaint about Trump’s Ukraine communications with the Intelligence Community inspector general, and Schiff knew about it but did not immediately inform his Republican colleagues on his panel.

The Washington Examiner has reported that two ex-NSC staffers are now employed by Schiff. Abigail Grace, who worked at the NSC until 2018, was hired in February, while Sean Misko, an NSC aide until 2017, joined Schiff’s committee staff in August, the same month the whistleblower submitted his complaint. House Democrats’ first impeachment inquiry public hearing on Wednesday was widely panned as the two career diplomats who testified failed to offer clear allegations of wrongdoing against President Donald Trump, and Democrats running the show found themselves on defense in response to the Republicans in the minority who were aggressive and effective in pushing their counter-narrative.

“It was a total disaster for us,” one senior House Democrat aide told Breitbart News.

“Too complicated,” another Democrat aide said.

“This won’t make sense to regular people,” a third Democrat aide told Breitbart News.

Wednesday marked the first public hearing of the Democrats’ formal impeachment inquiry into President Donald Trump. The hearing opened slowly, taking 93 minutes for the panel’s chairman Rep. Adam Schiff (D-CA) and it’s ranking member Rep. Devin Nunes (R-CA) as well as the two witnesses Bill Taylor and George Kent to get through their opening statements.

Taylor’s opening statement, which he read in its entirety, was 20-pages-long and contained lots of unclear background information. Kent’s, which was nearly as long and winding, contained numerous history lessons about Europeans helping Americans in the Revolutionary War.

A senior administration official told Breitbart News, too, that the Democrats have made a “colossal political mistake” by proceeding with this impeachment push despite the weakness of their case. The Democrats do not seem to have moved any hearts or minds with Wednesday’s disjointed round one hearing, as evidenced by GOP unity at the end of the day, when Rep. Mike Conaway (R-TX) pushed to try to bring in the so-called “whistleblower” for testimony. The vote failed, but along party lines with all 13 of the committee’s Democrats voting against the effort and all nine Republicans voting for it.

What’s more, several Republicans across Capitol Hill have now come out even more fervently defending the president. Sen. Kevin Cramer (R-ND), a top Trump ally, for instance, issued a blistering statement ripping Democrats for the gamesmanship.

These hearings are pointless.Today’s political theater in the House of Representatives is nothing more than an outward demonstration of their inward motivation to remove President Trump from office since the day he was elected. Democrats’ one-sided impeachment process is producing no persuasive substance; their only accomplishment is further dividing our country. It’s time for them to call it quits on this sham and to finally get to work on the important issues like passing USMCA, lowering prescription drug costs, and funding our nation’s military.

Turley: House Dems Going on ‘Narrowest Basis for Impeachment’ in U.S. History

During CBS’ coverage of the impeachment hearing on Wednesday, George Washington University Law Professor Jonathan Turley stated that while there is plenty in President Trump’s conduct to be upset over, House Democrats are “proceeding on the narrowest basis for impeachment in the history of this country.” He also expressed skepticism as to whether Democrats “gained a lot of ground” with regards to impeachment.

Turley said, “I think that there’s a lot to be outraged about. You certainly don’t need a crime for impeachment, but you do need clarity. And they’re proceeding on the narrowest basis for impeachment in the history of this country. We’ve never gone up with an impeachment just on abuse of power linked to a single controversy like this. That is a very slender basis. And I’m not too sure they gained a lot of ground on impeachment, as opposed to, all of this does not seem right to many of us. There’s a lot here that makes us all upset. But the question is, is this really an impeachable offense, and how do you distinguish what the president did here with what presidents do in conversations with heads of states?”

First Hour Fail: Democrats’ ‘Blockbuster’ Opening Hour Fizzles

Democrats opened public impeachment hearings on Wednesday promising to dramatically detail the case for the president’s impeachment, but there was little excitement in the first 93 minutes.

House Intelligence Chairman Adam Schiff began the proceedings with a solemn statement recounting the events that sparked the impeachment inquiry.

Ambassador Bill Taylor and Deputy Assistant Secretary George Kent, the two bureaucrats selected by Schiff to kick off the public impeachment hearings also failed to deliver much drama.

Taylor and Kent began their statements recounting the history of diplomacy in the United States as well as the history of Ukraine and their lengthy careers of public service.

Both bureaucrats expressed their concerns about the president’s actions in Ukraine but proved that they were frequently alarmed and concerned but mostly did not have knowledge of the president’s motives.

Taylor read his 20-page opening statement, even admitting that although it was lengthy, he hoped Americans would recognize the importance of Ukraine in future diplomatic efforts.

Taylor said one of his staff claimed to overhear European Union Ambassador Gordon Sondland discussing “the investigations” in a phone call with the president.

No members of Congress were allowed to interrupt the opening of the hearing with questions as the two diplomats droned on recounting their previously released public testimonies about the case.

Through a parliamentary inquiry, House Republicans successfully tripped up Rep. Adam Schiff to claim that he did not know the identity of the so-called “whistleblower,” despite reports that his committee had met with him prior to his claim.

President Donald Trump said Wednesday that he was too busy to watch the first public impeachment hearing, as he hosted Turkish President Recep Tayyip Erdogan at the White House.

“I’m too busy to watch it,” he said. “It’s a witch hunt, it’s a hoax, I’m too busy to watch it.”

Trump said that he would get briefed on the day’s testimony later in the day.

He commented that he had heard that Democrats were using “television lawyers” to question the witnesses at the hearing.

White House Press Secretary Stephanie Grisham called the hearing “boring.”

“This sham hearing is not only boring, but it is also a colossal waste of taxpayer time and money,” she wrote on Twitter.

House Democrats spent the first 93 minutes on opening statements before members of Congress could question the witnesses.

The White House also released a video at noon with the president declaring the investigation as the “single greatest scam in the history of American politics.”

He reminded supporters that Democrats wanted to take away their guns, health care, vote, freedom, and judges with the impeachment process.

“It’s all very simple, they’re trying to stop me because I am fighting for you and I will never let that happen,” Trump said. Source

Why is this “impeachment” circus a clown show?

First, there’s the absurd idea that it’s somehow wrong for Trump to demand Ukraine investigate its own role in the 2016 deep state coup attempt against the Trump campaign. It turns out the United States of America has a law enforcement treaty with Ukraine that actually demands bilateral cooperation on such criminal investigations.

Secondly, there’s an even more absurd idea that Obama and the Dems somehow never pressure anyone to do anything in exchange for foreign aid. As “Quid pro-Joe” has openly admitted, it was routine for Obama officials to not just demand payoffs and bribes from nations like Ukraine, but to even publicly brag about it on national television. We now have the records of the actual financial transactions where Burisma Holdings of Ukraine issued 38 payments to Hunter Biden, totally more than $3.1 million. Former Vice President Joe Biden publicly bragged about pressuring Ukraine to fire a prosecutor who was investigating the corruption and fraud involving the Bidens, and Joe Biden proclaimed he would withhold a billion dollars in foreign aid funding unless that prosecutor was fired!

Does that mean Adam Schiff is holding a public trial over Joe Biden’s admitted corruption and extortion? Of course not. The Democrats pretend that never happened. Instead, they are fabricating the hoax that claims Trump did what Joe Biden actually did.

Like always, the Democrats are projecting their own criminal fraud, extortion, blackmail, and other crimes onto Trump. Everything the Democrats claim Trump did was actually carried out by the Democrats themselves.

Adam Schiff is now pretending he has no idea who the “whistleblower” really is

Like every theatrical production you’ve ever attended, it’s all scripted for effect. No one is allowed to deviate from the script, and the Dems exert total control over which witnesses are allowed to speak and what they’re allowed to say.

In fact, one of the most hilarious requirements of this Schiff show is that no one name the so-called “whistleblower” who is, of course, nothing more than a deep state spy who initiated this entire Schiff show by claiming he overheard a Trump call with Ukraine during which terrible things were supposedly said. This “whistleblower” is now widely reported to be Eric Ciaramella, who even Sen. Rand Paul has publicly named. But Ciaramella is a Schiff / Brennan operative who works for the deep state, and he’s part of the very same cabal of deep state traitors who have been trying to carry out an illegal political coup against our president for the last three years.

As The Gateway Pundit reported, “Trump War Room co-host Raheem Kassam noted problems with Schiff’s denial, ‘Schiff says he doesn’t know the identity of the whistleblower, despite his staff being in contact with the whistleblower. Ok, but if he doesn’t know the identity, how can he as the Intel Chairman stop the whistleblower being named? And how is the name being redacted in docs?’”

An intelligent person might ask how Schiff would know if anyone named the whistleblower if, as Schiff claims, he doesn’t know who the whistleblower is. Then again, you’re not allowed to ask intelligent questions, and you’re not allowed to know the names of the “anonymous” accusers who, almost without exception, are citing other anonymous sources who claim to have a third- or fourth-hand knowledge of something that wasn’t even illegal in the first place.

It’s all a Shiff Show.

And it’s all being run like the circus theater it has become… scripted for the TV cameras and carried out with a level of arrogance that insults the intelligence of every thinking American.

In reality, what the Democrats are doing here is called treason, and if real justice were to be served in this country, every last one of them would hang for their treasonous crimes against our nation, after being convicted in a court of real law.

Perhaps some of them eventually will. According to news rumors, the DOJ is on the cusp of releasing reports that will expose the criminality of the deep state operators who masterminded this coup in the first place (Brennan, Comey, McCabe, Strzok, etc.). That’s why Schiff is rushing the impeachment theater, by the way, in the hopes of removing Trump from office before the DOJ investigations can be completed and released.

So it’s a race against the clock, with the Dems fully realizing that if they don’t remove Trump from office, many of them will be indicted by the DOJ.

Haven’t the American people had enough of the lawless, corrupt, dishonest Dems staging coup attempt after the coup attempt to try to overrule the American voters?

It’s time to clean up Washington D.C. and sweep the demonrats down the sewers once and for all. Arrest them all for treason and end the hoaxes, fabrications and deep state conspiracies that have long sought to overrule the will of the people and run America as a criminal cartel that only benefits the special elite.

The Impeachment Pantomime – A Primer

The political theatrics that begins today raises several questions. For starters, will Joe Biden be investigated for mounting evidence of corruption? And why is the corporate media turning the CIA “whistleblower” into a phantom in plain sight?

Now that “Russiagate” has failed and “Ukrainegate” neatly takes its place, many questions arise. Will the Democratic Party, this time in open collusion with the intelligence apparatus, succeed in its second attempt to depose President Donald Trump in what might fairly be called a bloodless coup? Whatever the outcome of the thus-far-farcical impeachment probe, which is to be conducted publicly as of Wednesday, did the president use his office to pressure Ukraine on behalf of his own personal and political interests? Did Trump, in his fateful telephone conversation last July 25 with Volodymyr Zelensky, Ukraine’s president, but U.S. national security at risk, as is alleged?

All good questions. Here is another: Will Joe Biden, at present the leading contender for the Democratic presidential nomination, get away with what is almost certain to prove his gross corruption and gross abuse of office when he carried the Ukraine portfolio while serving as vice president under Barack Obama?

Corollary line of inquiry: Will the corporate media, The New York Times in the lead, get away with self-censoring what is now irrefutable evidence of the impeachment probe’s various frauds and corruption? Ditto in the Biden case: Can the Times and the media that faithfully follow its leaders continue to disregard accumulating circumstantial evidence of Biden’s guilt as he appears to have acted in the interest of his son Hunter while the latter sat on the board of one of Ukraine’s largest privately held natural gas producers? 

Innuendo & Interference 

It is not difficult to imagine that Trump presented Zelensky with his famous quid pro quo when they spoke last summer: Open an investigation into Biden père et fils and I will release $391 million in military aid and invite you to the White House. Trump seems to be no stranger to abuses of power of this sort. But the impeachment probe has swiftly run up against the same problem that sank the good ship Russiagate: It has produced no evidence. Innuendo and inference, yes. Various syllogisms, yes. But no evidence. 

There is none in the transcript of the telephone exchange. Zelensky has flatly stated that there was no quid pro quo. The witnesses so far called to testify have had little to offer other than their personal opinions, even if Capitol Hill Democrats pretend these testimonies are prima facie damning. And the witnesses are to one or another degree of questionable motives: To a one, they appear to be Russophobes who favor military aid to Ukraine; to a one, they are turf-conscious careerists who think they set U.S. foreign policy and resent the president for intruding upon them. It is increasingly evident that Trump’s true offense is proposing to renovate a foreign policy framework that has been more or less untouched for 75 years (and is in dire need of renovation). 

Ten days ago Real Clear Investigations suggested that the “whistleblower” whose “complaint” last August set the impeachment probe in motion was in all likelihood a CIA agent named Eric Ciaramella. And who is Eric Ciaramella? It turns out he is a young but seasoned Democratic Party apparatchik conducting his spookery on American soil.

Ciaramella has previously worked with Joe Biden during the latter’s days as veep; with Susan Rice, Obama’s recklessly hawkish national security adviser; with John Brennan, a key architect of the Russiagate edifice; as well as with Alexandra Chalupa, a Ukrainian-born Democratic National Committee official charged during the 2016 campaign season with digging up dirt on none other than candidate Donald Trump.

For good measure, Paul Sperry’s perspicacious reporting in Real Clear Investigations reveals that Ciaramella conferred with the staff of Rep. Adam Schiff, the House Democrat leading the impeachment process, a month prior to filing his “complaint” to the CIA’s inspector general.

This information comes after Schiff stated on the record that the staff of the House Intelligence Committee, which he heads, had no contact with the whistleblower. Schiff has since acknowledged the Ciaramella connection.   

Phantom in Plain Sight

No wonder no one in Washington will name this phantom in plain sight. The impeachment probe starts to take on a certain reek. It starts to look as if contempt for Trump takes precedence over the democratic process — a dangerous priority. Sperry quotes Fred Fleitz, a former National Security Council official, thus: “Everyone knows who he is. CNN knows. The Washington Post knows. The New York Times knows. Congress knows. The White House knows…. They’re hiding him because of his political bias.”

Here we come to another question. If everyone knows the whistleblower’s identity, why have the corporate media declined to name him? There can be but one answer to this question: If Ciaramella’s identity were publicized and his professional record exposed, the Ukrainegate narrative would instantly collapse into a second-rate vaudeville act — a farce by any other name, although “hoax” might do, even if Trump has made the term his own. 

There is another half to this burlesque. While Schiff and his House colleagues chicken-scratch for something, anything that may justify a formal impeachment, a clear, documented record emerges of Joe Biden’s official interventions in Ukraine in behalf of Burisma Holdings, the gas company that named Hunter Biden to its board in March 2014 — a month, it is worth noting, after the U.S.–cultivated coup in Kiev.

There is no thought of scrutinizing Biden’s activities by way of an official inquiry. In its way, this, too, reflects upon the pantomime of the impeachment probe. Are there sufficient grounds to open an investigation? Emphatically there are. Two reports published last week make this plain by any reasonable measure. 

‘Bursimagate’

John Solomon, a singularly competent follower of Russiagate and Ukrainegate, published a report last Monday exposing Hunter Biden’s extensive contacts with the Obama State Department in the early months of 2016. Two developments were pending at the time. They lie at the heart of what we may well call “Burismagate.”

One, the Obama administration had committed to providing Ukraine with $1 billion in loan guarantees. In a December 2015 address to the Rada, Ukraine’s legislature, V–P Biden withheld an apparently planned announcement of the credit facility.

Two, coincident with Hunter Biden’s numerous conferences at the State Department, Ukraine’s prosecutor general, Viktor Shokin, was swiftly advancing a corruption investigation into Burisma’s oligarchic owner, Mykola Zlochevsky, who was by early 2016 living in exile. Just prior to Biden’s spate of visits to Foggy Bottom, Shokin had confiscated several of Zlochevsky’s properties—a clear sign that he was closing in. Joe Biden wanted Shokin fired. He is, of course, famously on the record boasting of his threat [starts at 52.00 in the video below]to withhold the loan guarantee as a means to getting this done. Shokin was in short order dismissed, and the loan guarantee went through. 

Solomon documents his report with memos he obtained via the Freedom of Information Act earlier this year. These add significantly to the picture. “Hunter Biden and his Ukrainian gas firm colleagues had multiple contacts with the Obama State Department during the 2016 election cycle,” he writes, “including one just a month before Vice President Joe Biden forced Ukraine to fire the prosecutor investigating his son’s company for corruption.”

Last Tuesday, a day after Solomon published his report, Moon of Alabama, the much-followed web publication, posted a granularly researched and well-sourced timeline of the events surrounding Shokin’s dismissal at Vice President Biden’s request. This is the most complete chronology of the Burismagate story yet available.

In an ethical judicial system, it or something like it would now sit on a prosecutor’s desk. There is no suggestion in the Moon of Alabama’s timeline that Shokin had shelved his investigation into Burisma by the time Biden exerted pressure to get him sacked, as Biden’s defenders assert. Just the opposite appears to be the true case: The timeline indicates Shokin was about to pounce. Indeed Shokin said so under oath in an Austrian court case, testifying that he was fired because of Biden’s pressure not to conduct the probe.

It is important to note that there is no conclusive evidence that Joe Biden misused his office on behalf of his son’s business interests simply because there has been no investigation. Given what is beginning to emerge, however, the need for one can no longer be in doubt. Can Democrats and the media obscure indefinitely what now amounts to very strong circumstantial evidence against Biden?

We live in a time when the corporate media make as much effort to hide information as they do to report it. But as in the case of Ciaramella’s identity, it is unlikely these myriad omissions can be sustained indefinitely — especially if Biden wins the Democratic nomination next year. Forecast: If only because of Burismagate, Joe Biden will never be president.

As everyone in Washington seems to understand, it is highly unlikely Trump will be ousted via an impeachment trial: The Republican-controlled Senate can be counted on to keep him in office. Whatever Trump got up to with Zelensky, there is little chance it will prove sufficient to drive him from office. As to the charge that Trump’s dealings with the Ukrainian president threatened national security, let us allow this old chestnut to speak for itself.

Price of Irresponsible Theatrics

This leaves us to reckon the price our troubled republic will pay for months of irresponsible theatrics that are more or less preordained to lead nowhere.

More questions. What damage will the Democrats have done when Ukrainegate draws to a close (assuming it does at some point)? What harm has come to U.S. political institutions, governing bodies, judiciary, and media? The corporate press has been profligately careless of its already questionable credibility during the years of Russiagate and now Ukrainegate. Can anyone argue there is no lasting price to pay for this?

More urgently, what do the past three years of incessant efforts to unseat a president tell us about the power of unelected constituencies? The CIA is now openly operating on American soil in a clear breach of its charter and U.S. law. There is absolutely no way this can be questioned. We must now contemplate the frightening similarities Russiagate and Ukrainegate share with the agency’s classic coup operations abroad: Commandeering the media, stirring discontent with the leadership, pumping up the opposition, waving false flags, incessant disinformation campaigns: Maybe it was fated that what America has been doing abroad the whole of the postwar era would eventually come home. 

What, at last, must we conclude about the ability of any president (of any stripe) to effect authentic change when our administrative state — “deep,” if you like — opposes it? Source

Nancy Pelosi just took the biggest gamble of her entire political career.  If she is ultimately successful, she will be remembered as the woman that removed Donald Trump from the White House, and Democrats will treat her like a hero for the rest of her life.  But if she fails and Trump wins in 2020, the backlash that she created when she tried to impeach Trump is likely to be blamed, and she could potentially lose her leadership role in the House.  Of course, at that point, she probably wouldn’t want to remain in the House much longer, and she would be hated by many Democrats for the rest of her life for subjecting them to four more years of Trump.  So it really is all on the line for Nancy Pelosi, and she never should have gone down this road if she wasn’t absolutely certain that she could deliver.

People often talk about impeachment as if it were identical to removing the President from office. However, this is not the case. In order to remove a President from office, the House of Representatives first has to impeach him, and then the Senate has to convict him. Note that President Clinton was impeached by the House in 1998, but he was subsequently acquitted by the Senate, so he was not removed from office. The only other President who was impeached by the House was Andrew Johnson in 1868, but he was also acquitted by the Senate. Formally, no US President has ever been removed by impeachment and conviction. When the Republican leadership informed Richard Nixon that impeachment and conviction were inevitable he resigned prematurely and it never came to a vote.

Due to the two-stage procedure of impeachment and conviction, it is not that easy to remove a President from office. What’s more, while for impeachment in the House of Representatives only a simple majority of more than 1/2 is needed, a conviction in the Senate requires a 2/3 majority. At present, the Democrats have a 235-198 majority in the House (1 independent, 1 vacancy). In contrast, the Republicans have a 53-47 majority in the Senate (2 independents formally caucus with the Democrats). Assuming that all the Democrats vote for impeachment and conviction, it would take 20 Republican defectors in the Senate to remove the President from office. This equals about 38% of the Republican Senators. So while impeachment is within reach of the Democrats, the hurdle for conviction is much higher.

This makes for a dramatic coup de théâtre, but it’s still only that: theater. Pelosi lost face, yes. 

And at this point, most Americans don’t want impeachment proceedings to happen.  For example, just check out what a Politico/Morning Consult poll just found

In the poll — conducted Friday through Sunday, as stories circled about Trump allegedly pressuring Ukraine to investigate former Vice President Joe Biden, one of the Democratic candidates hoping to oust him — 36 percent of respondents said they believe Congress should begin impeachment proceedings against Trump.

Other surveys have come up with similar results, but there is one survey out there that indicates that most Americans would actually support impeachment proceedings if the evidence shows that “Trump did use his presidential power to force a foreign leader to help take down a political rival”

House Speaker Nancy Pelosi announced on Tuesday the opening of a formal impeachment inquiry against Trump in response to the Ukraine controversy. If it’s found that Trump did use his presidential power to force a foreign leader to help take down a political rival, 55 percent of U.S. adults said they would support removing him from office, according to a recent YouGov survey.

Forty-four percent of those polled said they’d “strongly support” removing Trump if the allegations are true, while another 11 percent said they’d “somewhat support” it.

But as it stands right now, on the national level this is a very unpopular decision by Pelosi, and it could potentially hurt Democrats among key blocs of voters

Worse yet, impeachment isn’t selling where Democrats made their best gains in the midterms. A majority of suburban respondents oppose starting the impeachment process (35 percent/50 percent), with a wider gap among rural respondents (27/59), while urban voters are more ambivalent than one might guess (47/35). Impeachment trails by double digits in the South (33/53), Midwest, (36/48), and even in the Democrat-friendly Northeast (37/48).

Another reason why this is potentially a giant mistake by Nancy Pelosi is the fact that all of this focus on Ukraine is almost certainly going to damage one of the frontrunners for the Democratic nomination. Source

House Speaker Nancy Pelosi initiated a formal impeachment inquiry by alleging that the administration was hiding the whistleblower complaint.

When the White House released the transcript of Trump’s call to the Ukrainian President Volodymyr Zelensky, it proved that there was no pressuring whatsoever, and Zelensky himself said during a Wednesday press conference that “nobody pushed me.”

After braying for the release of the transcript for 24 hours, Democrats suddenly lost interest in it when Trump released it, with Pelosi even admitting she hasn’t even read it, but still damning the President over the call with Zelensky.

Earlier in the day, the White House released a declassified transcript of Trump’s July call with Ukrainian President Volodymyr Zelensky, showing Trump sought a review of former Vice President Joe Biden’s efforts to have Ukraine’s former top prosecutor fired.

Joe Biden has acknowledged on camera that, when he was vice president, he successfully pressured Ukraine to fire that prosecutor, Viktor Shokin, who was investigating the natural gas firm Burisma Holdings — where Hunter Biden had a highly lucrative role on the board paying him tens of thousands of dollars per month, despite limited relevant expertise. Shokin himself had been widely accused of corruption, while critics charged that Hunter Biden might have been essentially selling access to his father, who had pushed Ukraine to increase its natural gas production.

Trump made the request on the call for Ukraine to look into the Bidens after Zelensky first mentioned Ukraine’s corruption issues, and after Trump separately requested as a “favor” that Ukraine help investigate foreign interference in the 2016 elections, including the hack of the Democratic National Committee (DNC) server involving the data security company CrowdStrike.

Multiple news outlets — including The New York Times, CNN, MSNBC, and The Washington Post — inaccurately reported that the “favor” related specifically to investigating Biden.

Since impeachability is a political decision rather than a legal matter, history will tell whether starting an impeachment inquiry was the right decision for the Democrats.
